I have been a Straight Talk BYOP customer for more than a year. I have never had a problem with data usage until recently. I bought a new phone, AT&T HTC One X, to use on the $45 Unlimited* service with the AT&T compatible SIM card.

After only 6 days, my data stop working. Thinking it may be a problem with the APN settings on my phone, I called the Straight Talk Customer Service call center and spoke to a CS representative about the issue. I was informed that my service was now suspended for violating the "Terms and Conditions".

Specifically sections 6 and 7. I referred to sections 6 and 7 only to find out that there is vague language about what is and not allowed as far as data usage. I asked for clarification on the exact violation that prompted the action against my account.

I was told to just read it and I would know. Then I was given a number that was susposed to connect me to someone who would be able to explain it better. This number was to nothing more than a recording telling me that I am a "High Data" user. Then was given tips how to keep usage low. None of which was helpful in my situation.

I have since been in email contact with Straight Talk. After multiple emails, I still only get a referal to the general Terms and Conditions section's 6 and 7. With the following statement,

"...On the other hand, please be informed that we currently do not have the specific limit for data usage when using the mobile internet. The safe usage of data varies, depending if it has cause impact to our service and has alter our service level, or when usage has already violates the Section 6 and 7 of our Terms and Condition."

This statement also leaves an open window for them to just pick and choose when they want to take action against a customer.

I am curious though, "If you are operating an ATV across the desert, with no known speed limits - posted or otherwise listed, can an officer of the law stop you and give you a ticket?

They directed you to the terms and conditions and were very specific.  In their terms in conditions it does state that they reserve the right to suspend service in certain types of situations:  Using your phone as a hotspot, downloading questionable content (pirated movies etc) and they can tell this by the signatures in your data plus what you are using to browse the internet.  This isn't normal use as described in the terms and conditions.  I actually work for a different carrier but when I get these stores this is pretty much the answer to it.
