your husband has 30 days to take the restest so why do you say "Because everything is costing thousands yet again!!!" what thousands.....? all he has to do is pay to retest not take classes again thats what $100-$200 maybe all he needs is a truck and trailer for the day to take the retest.... and the company he works for should let he use the one he has been driving to do it after all his CDL IS STILL GOOD for 30 days. if he's not working RENT ONE it's realy not that big a deal to do. just go to penske and ask them (most everyone in trucking knows about what happened at swift) thay may cut him a deal on a one day rentel. and if he talks nice to them they may take the truck and trailer to the testing site for him. heck if i lived in ohio i'd let hime use mine for $100 plus fuel for the retest after all it's just A RETEST (writen, vison, pre-trip, backing and driving test) if he's been driving for 3 years he should beable to do it. as for the "class action suit" who are you going to sue...? swift....? (wrong) swift had NOTHING to do with it. it was the third party tester that was at fault so if your going to sue then sue HIM "An attorney said that he never heard of such a thing" the attorney you talked to sure doesn't lissen to the news much, things like this have been going on for years. "Capri Cafaro our State Senator is going to investgate" i don't know what your senator is going to investgate, tennessee already do thats why your husband got the letter. it could have been worse most of the time when this happens you got a letter that your cdl IS SUSPENDED NOW not giving you the 30 days. don't get me wrong i feel it was a raw deal what happened to all the drivers that when to that school and i hope that your husband can get it worked out. but doing a retest is not that big of a deal realy yes i think your husband SHOULD sue the tester, BUT all he can sue for is what he paid the tester (about $100) and MAYBE the retesting fee.
