Everything that I state in this complaint is a fact.  Nothing in this report is false or opinion.  I have the documented proof.  The documentation stands for itself and is indisputable.  Criminal Complaints have been filed with local, state and federal agencies. 

On 06 October 2014, I began a leasing process with Charles Smith (alleged owner) and Billy Hart (alleged property manager) over the internet through VRBO.  The property name and location is:

On 07 October 2014, a wire transfer was made from USAA Bank in San Antonio, TX to the owner (Charles Smith / Billy Hart) in the amount of Two Thousand Nine Hundred and Thirty Four ($2,934.00) Dollars in US Currency for the above property.  The date of lease was 19 December 2014 thru 08 January 2015.  (The owner and/or property manager sent me a Cancellation Lease Agreement with a 60 day / 100% refund.  SEE ATTACHED Cancellation Policy and Rental Agreement.).

On 17 October 2014, I contact Charles Smith / Billy Hart at [email protected] and cancelled my reservation.  After not receiving a confirmation, I called and spoke to someone who identified themselves as Billy Hart.  Billy Hart told me that they would not refund my money, that cancellations would not receive refunds.  I learned that said party(s) changed their cancellation policy after the fact and deprived me of $2,934.00 in US Currency.

I contacted my USAA Bank in San Antonio, TX and disputed the charges, explaining that the owner / manager would not refund my money and why.

I have documentation showing the property owner / manager’s (60 day / 100% refund) Cancellation Policy.  I have electronic screenshots of said Cancellation Policy from their site.  I have documentation that the owner / manager changed / updated the webpage after the fact.  Charles Smith, Billy Hart, Valerie Hart and person(s) unknown received $2,934.00 from an electronic wiring system.  They also used the internet to complete said transaction and the change to their Cancellation Policy to deprive me of said money.

I am in the United States Armed Forces.  I am overseas working as a Military Advisor in the Middle East.  I am also a Sixteen (16) year former Federal and State Certified Law Enforcement Officer.  I am appalled that a United States Citizen would try to take advantage of another United States Citizen overseas.
