Recently, the apartment where I have been residing for the last three years ran my credit to check for rental violations. I just retired from the military and have never seen this item for a judgment for forcible entry detainer, meaning a vagrant or someone broke into the apartment after my family moved out in February 2008 nn   and I was overseas with the US Army. I had co-signed with my sister for this place to take care of my children while I was overseas and paying the rent until the lease expired in 2008. The Lynd Company filed a judgment against me in court that I was not able to attend the court hearing being overseas. For the vagrant violation in November 2008. My family was in anoher home by this time so it had to be someone I was not associiaed with at the tme. Thisis keeping me from qualifying for another rental unit and it is not a valid claim. And they did not bother to verify the claim before filing this judgement against me.

Let me say my sister has a bipolar disorder and does not remember much of the events in February of 2008, but my daughter who is sane and had turned 21, that year, stated my sister received an eviction notice in January and they  made sure she turned in all the keys in February. and my daughter and my brother helped her to move out. So, this action taken in November 2008, reflects something that occurred in February and she stated, she remembers a lock being put on the door to prevent her from re-entering. So, what is this forcible detainer on my credit history, if someone entered the apartment after we left I am sorry, I would not know, I was still overseas in the military fighting for my country. This has to be an error and I need it corrected so that I am able to rent another apartment in WA state. I am about to be homeless at this point because i am renting month to month because of this. So, my rent is 1750.00 and I cannot afford this, since I have now retired. Thank you for your attention to this matter, if you cannot take care of this, I will have to get an attorney, I need to continue to provide a home for my children.

There is a very important part of this missing.   The exact timeline, and order of events.

First of all when did the Lease end in 2008?  Was it Feburary or later in the year?

When the Lease expired did you(or your sister) notify the landlord you were leaving and go through the rest of the steps such as turning in the keys? 

This is important for a couple of reasons.  First until the management is notified you are leaving and you do things such as turn in the keys you are still 100% responsible for the apartment.  If your lease expired in October(for example).  Come November 1st if the Management company still did not hear from you they have to assume that you are still living there.  Yes, even if you moved out in February and still paied on the apartment you must notify them at the end of the lease.  Even if their isn't a stick of furniture in the apartment.  They must take the appropriate  (legal) action to make sure you are not still living there. 

Your sister since she Cosigned on the apartment should have been the one to "close out" this apartment upon the lease expiring since you were overseas. 

This sounds what like most likely happened, as if the management company was aware of you leaving and you actually left.  There would be no reason to file any detainers.  As they would have a date you left.  So any vagrants who moved in afterwards would not be your responsibility

Again timing is important because depending on when you were sent on Active Duty Overseas, you MAY be able to have gotten releif under the SCRA(Serviceman's Civil Relief Act).  This may have allowed you to break the lease without Penalty so you didn't have to pay it out.  It also may have barred them from trying to sue you while you are overseas.
