I worked for Tom for over a year & his office employees and himself were always very good to me They paid in a timely manner every week, they always made sure my permits and inspections were done on time, and my reimbursements were always paid. I personally never had a problem with them and they were the only stable thing I had going through a very difficult time in my life. Nobody can make you run illegally, that's the drivers choice. If you don't have permits then say NO. That simple.

I am also a female driver and I never had a problem with any sexual harassment from anyone affiliated with the company. I was treated with great respect by everyone and enjoyed working for them. Sorry you feel the need to complain, but it just doesnt hold water. No company cant make you run illegal, and I personally know if you asked Tom, or the office dispatch they would've told you not to do it. Tom was always available for questions on his own phone and was one of the best employers I had  to work for. I firmly believe if Tom wouldve known about any sexual harassment he would've kicked their butt up between their shoulders, you should have reported it to him, yet instead you cry about it here? So far you have not stated you reported it anywhere else to have it resolved.

You should really make war in the right places if you choose to do so. It would look much more believable if you knew even the basic laws for drivers and you took the right actions rather than an online tantrum with such morbid grammar. Honestly it makes you look kind of silly. Sorry you had such a bad experience with them. My experience with them was pretty awesome and I made really good money with them.

Good luck in your future endeavors.

No Ramey, that's not the way the law works..

Ramey,

No employer can "make you" run illegally.

BY LAW, the DRIVER is REQUIRED to ensure the vehicle and the load are in compliance BEFORE taking that vehicle out onto public roadways. The same goes for hours of service compliance, valid med card, etc.

All compliance is the PROFESSIONAL DRIVER's responsibility.

That's the law.

With that said, if you CHOOSE to accept that illegal truck, load, etc..Then it is ON YOU!

(Legally).

The problem is that too many drivers are broke, and borderline derilect, and are so scared of losing their worthless job, they will just do it and not say anything (until they get popped).

JUST SAY NO to illegal and unsafe operation.

Did you know that if you are running in any way out of compliance and you have an accident, it is automatically your fault? Yep, absolutely true. If someone dies in that accident, your accident just became criminal. You gonna take that manslaughter charge for that lowlife employer?

Think about it.

I know for a fact that this company and the specific owner/operator mentioned does make his drivers run the outlaw loads with either no permits or doctored outdated permits by changing the truck and/or trailer numbers or have you run a permit that was issued to another truck. It is also true that when you are in a disagreement with this company they will keep your entire check by drumming up so called charges that you have never heard of like old maintenance charges that suddenly appear after months or repair bills that were misplaced but suddenly found by the office manager and his wife who happens to take care of the repair bills. It is also true that the trucks do change hands very rapidly. You can payoff the trucks but yet Tom never gives you the title because once again they find new repair bills or he just flat out ignores you when you try to reach him to discuss the matter. When you ask the office to produce the file on your maintenance account they will never give it to you, it is excuse after excuse. This company is definitely a rip off!!!!

But i would go with sexual harassment because you broke the laws willingly, you even said you had a load of pipe 60 feet long with no permits. You should not have moved the truck with the exception of going to the nearest place to pick up the permits, and if you had to cross scales to do that then I would not have moved it.

In this business, because you are in the drivers seat you have to take most of the heat and that is how most companies get away with so much,oh we didn't tell them to do that. So,CYA,because no one else will.

Best of luck and God Bless.

No company can force a driver to run illegally.

Under both Federal and State Laws, NO COMPANY can force a driver to run illegally.

You ran illegally only because you were stupid and/or desperate.

The whole purpose of the CDL as we know it today, made the driver the point of final responsibility. As a CDL holder, you are REQUIRED by law to just say NO to illegal requests.

As a CDL holder you are REQUIRED to report illegal activity of your employer if you do not want to be held liable for it.

No one "forced" you to run illegally.

You did that all on your own.

Unfortunately you cannot have it both ways.

The current laws force you to put yourself in the position of saying no, and losing your job, or saying yes, and paying the price when you get stopped.

BUT, if you are fired for refusal to operate illegally, you are protected by anti-retaliation and whistleblower laws. You can get compensated, but you will be unemployed all the same.

Now for the good news!

Your employer broke the law by withholding your pay.

File a wage claim with your state wage and hour division.

Also file a complaint with FMSCA for the unsafe and illegal operation the company asks you to engage in.

I can tell by the response of the alleged "employee" that they have the attidude of "you either want your job or you don't", which is illegal when it comes to compliance issues.

Also file with the EEOC for the "hostile workplace" and/or sexual harassment, etc.

Did your permit tell you that you could not be inside of 465? Didn't the truck get impounded because you had an outstanding warrant? I feel like you should tell the whole story them let people judge if you were ripped off.

You still had a job, you didn't show up to get back in the truck so you could make some money. I just feel as though with only telling part of the story you're doing an injustice to yourself and to T & T farms.
