The reason that UCB continues to get away with all the violations with the FDCPA is that there are very few attorneys that will take these kinds of cases. I did manage to get a law firm to take my case agaisnt UCB but then 2 months later they told me there is no precedent in the state of Ohio for FDCPA violators. They dropped my case. UCB knows that the only way they can be held liable for the gross violations they use on a daily basis is the have the Federal Trade Commission file a class action suit against them. I tried and the FTC told me they dont have time for individual complaints. We have to get together and storm the Federal Trade Commission to let them know UCB violates just about every code there is.

I dont have an account with them, however, I used to work for their other company, and was fired because the manager diagreed with me. After a long drawn out process, I did begin to receive my unemployment, but it was only after they LIED to the state and told them they fired me for a fight with my supervisor, but I kept on fighting it and won. This company is one of the most unethical companies I have ever worked for!

Do a search for FDCPA (FAir Debt Collection Practices Act) You can find many rules that these scumbags violated. For example: 805. Communication in connection with debt collection (for details read the Act) Those guys violated every word of it.... Or quote from 808.: The following conduct is a violation of this section: (2) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit. (4) Depositing or threatening to deposit any postdated check or other postdated payment instrument prior to the date on such check or instrument. It means that the CA cannot force/ accept any "scheduled" payment without WRITTEN notifiacation. Deifinitely CA is forbidden to deposit any check (charge your checking account) prior the date in this WRITTEN notification. My recommendation would be to write a certified letter to the collection agency, quote all the violations, mention, that you send the same letter to the State Attorney (and do it). Do NOT sign the letter you send to the collection agency. I would not recomend further phone communication.

I unfortunatly also have an account with UCB. I owed Sears about 2k. I called them to set up payments with a "Ms. Jullien". Deposit of 610.00 then payments equaling 330 dollars for for four months to pay it off. Told me that they could only run it as an ach/check out of my account. They ran March's payment twice, one day after the other. I called them on this (to make sure at least the money was credited to my account, I owe it, Im gonna pay it), and the man who took my call tried to get the 700 balance out of me right then and there. I advised him that they already got about 1300 out of me that month, I couldnt give him more. He proceeds to leave strange voice mails saying I am "ignoring my debt" (um, hello, what was that 1300 I gave you?) He called me at work and demanded I give him another check number. I told him he got May's payment and to stop calling. He continued, spoke with a "supervisor" who told me he would tell him to stop calling..he didnt. He was even calling my husband (who wasnt married to me when I aquired this debt nor is on the account) and was asking for him as "Kyle Travis", not his last name, the last name of my ex husband. Since they kept harassing me after repeated attmepts to get them to stop I called Bank of America, whom I bank with and asked them if I could prosecute for bank fraud (for running the same check number twice) she said yes I could. The next time he called I told him I was prosecuting for bank fraud, and that I was contacting an attorney becuase of them trying to get my husband involved in a matter that did not pertain to him. They havent called me since...and I am thinking after reading what they have done to others maybe just going after them for bank fraud.
