Obtained 2nd Mortgage thru Upland Mortgage in 2001, using local metro Atlanta address in Roswell, GA. Lender made us jump thru many hoops before signing papers and was then told we had to wait 3 business days (cooling off period) before they would send check. On third day I called to cancel transaction and person stated check was already sent and that the paperwork was processed.

Since then, I've made every payment on-time and the exact amount agreed. I noted a fine print penalty for pre-payment amounts totalling 50% of amount paid.

Before Thanksgiving 2002, I started process to re-finance 1st Mortgage for lower interest rate. Everything proceeded well UNTIL the new lender contacted Upland Mortgage. First, they would not send any reports, paperwork to new lender. Finally they refused to sign release to agree to be the 2nd Mortgage Holder on the new loan. REASON: Our house had not been re-appraised in the YEAR since we were appraised for the 2nd loan.

I attempted to contact local Upland office in Roswell and found they had closed the office. The reason: Georgia had passed a tough predatory lending law in 2002, and Upland was worried about being held accountable.

Finally... after as many as 30 calls to various offices, departments, managers, vice-presidents, and the president of AFBS.. I threatened to physically go to the Philly area and contact the local tv stations and visit the company offices EVERYDAY until someone actually took the time to review my file.

Upland stated that my house needed to be re-appraised by an Upland Appraiser, Catch-22, Upland had left Georgia, so there were no "Upland Appraisers" available. Got Upland to agree to allow re-appraisal by person who did their appraisal in 2001.

Even after all this... it took from mid November 2002 to Jane 2003, to close on the "simple VA Re-Fi"

Now, because my Social Security Checks come in the mid to later part of the month I am not able to send the 2nd Mortgage Payment to be received on the due date... BUT there is a 10 day grace period... BUT Upland had started calling within 5 days... asking where the payment is.......... even tho' I've Never been late !!!!

I will NEVER do business with this or any related company again !!!!
