So one of the "collection agent" named Luva calls me one day on my cell phone; I dont know how they got my cell phone number in the first place. Ofcourse I dont answer and wait to see if this person calling me with this number I dont know will leave a message, she left a message not identifying themself as a collection agency or anything at all. She left a message with a call back number, I asked one of my friends to call back and find out who it was. Turns out it was Luva from VCS and said she really needed to call her back to come to an agreement to pay off this account. So I giver her a call back and she lets me know that the original creditor Wells Fargo has turned in the account to VCS and there is a balance of 1,400.00 we came to an agreement that I was going to pay 150.00 for 6 months and she requested that I needed to write post dated checks for the 6 months and she made me repeat this into the phone while she rocorded what I was saying! After the 6 months she told me that my balance on the account would be around the 600 dollar range and we could settle the account at around 300 dollars; so this sounded fair to me and I agreed. I wrote 6 post dated checks and paid every one of those checks each month when due. So now that I have paid the 6 months off I was expecting Luva to call me back but intead it was someone else named Valerie who called me at work! She asks for me specifically by name and ofcourse she gets transferred to my extension at my office. She lets me know shes from VCS and wants me to write off more checks! I was caught off guard so I couldnt remember Luva's name at that time so I did the next best thing I aked her who was the person that helping me before so she looks up the information and lets me know its someone named luci???? I go with the flow and ask to be transferred over to this "luci" and she tells me she is no longer employed there, so I let her know that "luci" and I had an agreement that I would pay 6 months and then settle at around 300 and she said in a laud voice she no longer works here and we cannot settle on half unless the debt was over 10,000.00 dollars and then I aked her what the remaining balance on the account was and she said it was at $747.00. I have been reading about the FDCPA so I let her know not to call me at work anymore because its against company policies and told her to call me back next month and she agreed to that. As soon as I got off the phone I wrote a "cease communication" letter and mailed it off to thier Minnesotta location thorugh certified mail. If they do call back to harrass me for more money I will file a complaint with FTC on FTC.gov against this company. I am now in the process of getting help with my local CCCS and hope they can help me deal with these lying dogs.

Tristan, 1. Not speaking to a third party bill collector is your choice, but unless you know what is going on, it is not a safe bet to make. For example, I deal with preparing unsatisfied debts for litigation. (It does happen people!) Actually about that, you should know it is illegal for a collector to threaten legal action if that isn't the case. 2. If you know you owe a debt, and are unable to pay the balance, DON'T fight your collector, they are human just like you. Tell them what is going on and anyone worth their salt will help you figure out a solution. Mind you, it isn't always one you want to hear. 3. If an agency is asking for a check or credit card to pay your debt over the phone, then you should already have done your research. You can easily find out if it is a legit shop or not. If it is then you should know as well that any post dated check or credit card that is cashed even a day before the agreed upon date, that agency loses it's license to do business in your state. Period. 4. The only info a collector is looking for is some reason to show his or her client why they need to justify any arrangement other than what your contract dictated. Your intent here is to extend credit on a broken contract. The info a collector asks is no different from info you need to get a house or a car. I am not trying to get anyone more upset here, but I have read through a lot of these complaints and find misinformation,lies, and exaggerations all over the place. Like on about someone who though they "screwed" a bill collector over by paying the original creditor. I have news, that collector got his commission on that account anyway, and he stayed at that office for another year after his supposed "firing". Lastly, play with fire long enough and you get burned. I know that from personal experience. Yes, the consumer has rights, and they should have them. But so do your creditors and people easily forget the other side of that coin.

Tristan, The VERY FIRST rule when dealing with any third party debt collector, is to STAY OFF THE PHONE!!! DEMAND everything in writing, and you only communicate in writing via certified mail, return reciept requested. The SECOND RULE, is NEVER give any third party debt collector access to any bank account!! If for some reason you actually pay these bottomfeeders, use only certified checks from a bank that is not yours, or money orders. That's it. FYI...legally, there is NO SUCH THING as a "post dated check". FEDERAL LAW says that a check is "payable upon presentation" [regardless of the date on the check]. Therefore, they could have legally deposited all 6 checks at once and you would have had no recourse. Now, think about the common sense angle here, or lack thereof. You made a verbal agreement over the phone with someone you did not know, and then sent that unknown person 6 postdated checks. ARE YOU CRAZY????? Don't you think you should have demanded something in writing? Just common sense here. Now for the biggie! Was the debt legally collectable? Did you demand validation as per your rights under federal law? Was the debt past statute of limitations? Let's recap re: DEBT COLLECTIONS 101. 1. NEVER speak to any third party debt collector on the phone. 2. NEVER pay a third party debt collector without first making them jump through every legal hoop possible. 3. NEVER give any third party debt collector access to any financial account. 4. Never provide ANY personal, financial, or employment info to a debt collector. The legal burden of proof is on the debt collector to prove that you owe them the money, and that the debt is legally collectable.

I would close the account and reopen it with new #s iF these clowns ask for the new imfo refuse to give it. I would not trust them with my bank account
