On September 29th, 2007 at around 6:30 pm we went to VIP Honda, New Jersey to purchase a left-over 2007 Honda Odyssey EX minivan. Since it was closing time (7:00 pm), the sales man Mr. Abdul Fraser rushed in showing the van and signed a purchase order with $ 500 dollar deposit. I gave my credit card for deposit.

After seeing the car in the day light on October 2nd, 2007, I opted for EX-L for more features with slate green color. Since they dont have the slate green color for Honda Odyssey EX-L, they told that they will be able to locate the van from another dealer. The dealer agreed to ship the mini van from another dealer with no additional charge.

So I signed another purchase order for Honda Odyssey EX-L, without even seeing or test driving the car. Mr. Robert Farrell, the sales associate told me that he refunded the money for old transaction and made a new transaction on October 2nd, 2007. However he gave the old receipt.

The purchase order they made me to sign is even with wrong VIN #. The VIN # on the purchase order, which I signed, is not for a Honda Odyssey EX-L. A copy of the purchase order is attached.

After test-driving Honda Odyssey EX-L for the first time on October 8th, 2007, we were not satisfied at all with the new van. The mini van ride was not enough comfortable for us. More over some one put 48 demo miles on the new car, which I am not comfortable with.

I never took the van out of the dealers lot. Immediately after test-drive I told the dealer that I am not satisfied with new car which has 48 miles on it and requested for my $500 dollar deposit.

The dealer replied that they are there for making money and customer satisfaction is only second thing for them. More over he told that sales associate will loose his commission and as a result they cant refund the money back.

The VIP Honda dealer, the sales associate Mr. Robert Farrell and Mr. George Nealis forced us to buy Honda Odyssey EX-L, which we dont like with 48 demo miles.

If some one can help me in getting my deposit back, please guide me. If some one can help legally, it is appreciated.

When I asked the reason for not refunding the money, the dealer replied that sales associate will loose his commission and as a result they can't refund the money back. They are in the business to make the money. 3. The VIP Honda dealer, the sales associate Mr. Robert Farrell and Mr. George Nealis forced us to buy the unsatisfied 48 demo miles Honda Odyssey EX-L. But how can I buy the van, if I am not satisfed after the test drive ? As per the dealer, the customer must buy the van, even if he is not satisfied after the test drive. 4. If some one can help me in getting my deposit back, please guide me.

We were not satisfied with the ride and not interested to buy the van. The mini van ride was not enough comfortable for us. More over some one put demo miles on the new car, which I am not comfortable with. I never took the van out of the dealers lot. If some one can help me in getting my deposit back, please guide me. I do not want the van so I asked my deposit back. But VIP dealer is telling that the sales man will lose his commision and so they can't return the deposit. If some lawyers or media can help me, it is highly appreaciated.

You elected to. And the mileage could easily be from them retreiving it from another dealership. You don't know what dealer they got it from. They do not necessarily "haul it" on a tractor trailer doing a dealer swap or transfer. Many times they are driven.

Did you actually buy this van? It seems to suggest they 'forced' you to buy the van, which means you completed the transaction. If you did indeed take delivery of the van, the initial deposit of $500.00 would be applied as a down payment against your purchase. You would not be entitled to a refund, as the money was used as part of your payment for the vehicle. Most dealers, wisely, add a clause on the Purchase Order stating deposits for ordered or 'swapped' vehicles are not subject to refund. For the dealer to go get the car elsewhere for your purchase, they had to pay someone to drive the vehicle, not to mention the paperwork necessary to take the vehicle from another dealer's inventory. When you made the deal on the Honda and they told you they would get it from another dealer, did they specifically state the van would be picked up by flatbed? Did you specifically request they use a flatbed? If the dealer went to another store to get the van typically they trade a vehicle from their inventory to the dealer's who has the van you want. In order to actually trade, they have to drive their van to the store, and drive the one for your purchase back. It's not in the least bit unreasonable to expect a new car to have anywhere from 10 to 200 miles on it depending on the age of the vehicle in inventory. When you test drove the leftover 07, did you take into consideration that the person who eventually does purchase that van might not want the miles YOU drove it on the odometer? It's a two way street- if you expect to be able to go to a dealer and test drive a car, you have to expect the car you ultimately buy might have been test driven by someone else. In this case it sounds like it most likely was NOT ever test driven. When they come from the factory they usually have 8-12 miles on them, and if your dealer went to another store to drive it back, it's pretty likely they drove at least 30 miles back on the truck. 48 miles when you buy the car isn't going to affect the value of the van one iota. It sounds to me like you made a deal, and decided for some reason or other you weren't happy about the purchase, and this is the complaint you've hung your hat on. I would suggest you try your best to enjoy your purchase as it sounds to me like you've bought a car and honestly, there really isn't any way 'out' once you've signed the papers and taken delivery.

THE DEALER DECLINED TO REFUND THE DEPOSIT, WHICH THEY TOOK EVEN BEFORE SHOWING THE VAN. If some one can help legally to get back my deposit, it is appreciated.
