In the spring of 2010, we purchased a home complete with home inspection, etc.  Over the next year, the entire family started becoming sick.  We found black mold in the attic of the home and had it remediated but the sickness continued.  We had an environmental specialist come out and do an evaluation on the home and found that there were chronic water issues and mold behind the walls.  We were forced to move out because our health was quickly deteriorating. Knowing that we could not afford the mortgage payment and pay rent for somewhere to live, we got approved for a short sale and put the house up for sale complete with mold disclosure and documentation.

We had several offers and went with the best one. They ended up dropping out because of the time it took for the process so we proceeded with the next offer.  This whole process was being handled by a reputable real estate firm.  Wells Fargo had everyone jumping through hoops for documentation and multiple copies of signed documents that we had already sent them.

We kept requesting updates and finally after several months, out of the blue Wells Fargo said they were reviewing the package but they claimed that they didn't have a form so the property was no longer eligible for short sale.  They said that they were proceeding with the foreclosure.  

The attorney for Wells Fargo, Phelan, Hallinan & Schmieg, will not even speak with our attorneys.  They buyer is still interested! It is going to court now.

We were sold a sick, mold infested house that caused serious health issues to my daughter who was already fighting a hereditary nerve disease.  Then, when we try to do the right thing and not just walk away, Wells Fargo (who falsely advertises the fact that they are trying so hard to work with customers in default) shuts down the short sale without batting an eye. Off to foreclosure...

I posted a complaint on here about a similar situation but instead of selling because of a mold issue, I was trying to sell because of job relocation. I followed everything they initially said I needed to do, but kept closing out the process because they said I did not provide all the requested information. I feel as if they gave me a false sense of willingness and would have rather just foreclosed on the home. I never received any return phone calls and was expected to call them back for a reply to my concerns or problems. 

Have you found any recourse for what they did?
