Dear Mr. Daniel Hesse / Corporate Executive Officer,

I am writing to you to let you know I am extremely dissatisfied with the way I was treated recently at one of your Wireless Giant PCS stores.

On September 19, 2008 I went to the store at 163 N. Telegraph in Waterford, MI, 48328 because I was interested in getting a phone from PCS without a contract. I was approached by Tommy and explained to him that I was looking for the least expensive way to get a phone. I showed him my phone from a previous carrier and he said it could not be activated. He showed me two phones that each cost $99. I chose one and decided to try it because it had speakerphone capability. I was told it was fully charged.

After purchasing the phone I returned to the store when I got off work because I didn't know where to plug the charger into the phone. Tommy showed me and I noticed two holes in the back. Had I asked, perhaps he would have told me that one was for an ear bud. Instead, he decided to tell me that if I wanted to use the phone without putting it to my head or on speaker, I'd NEED a Bluetooth. I never asked for one but I took him at his word.

When I got home and opened the booklet for using the phone I saw a coupon for a FREE ear bud! I took the phone--which I barely used because I planned to return it--and unopened Bluetooth package back to the store on September 23. As I live in Detroit but work in Waterford, I waited to return the phone the next day I was due at work. The second night I had the phone, it had to be recharged even though I barely used it so I was also lied to about it being fully charged.

When I returned to the store, I told Tommy he had misled me by insisting I purchase the Bluetooth when he knew that I didn't HAVE to have one. He seemed startled after I told him about the free coupon for an ear bud. I guess he hadn't known that was in the box. He began to lie saying that I had ASKED for the Bluetooth. I told him he had misled me into thinking I HAD to buy one. I NEVER ASKED for one.

As I was getting no sensible reaction from him, I began telling the manager, Jeff Abro, what happened. He was instantly hostile. He accused me of having changed my story in an effort to confuse me, I believe. I told him I didn't think it was fair for me to have to pay a re-stocking fee since I had been misled from the start. His response was: I have to pay, you have to pay. I told him I shouldn't have to pay and as I was a dissatisfied customer, he should be offering me the phone number of his boss. I had to tell him that twice. He took back the Bluetooth and said something to the effect that I should be glad he did. He refused to waive the re-stocking fee and gave me his card with the phone number to call regarding my complaint. I signed my name on the slip he presented but crossed it out because I didn't agree to the re-stocking fee. I signed it again after being told that I wouldn't be credited for the phone. I did so under duress. I left after receiving my receipts but was not given back my copy of the purchase agreement.

On September 29, I called to complain at the corporate headquarters for Wireless Giant and was told someone would call me back soon. After at least 30 minutes had passed, I called again and the operator put me through to someone who could talk to me. I spoke with Tauhric Brown and told him my story. He didn't seem very interested and was even talking to someone else while I was on the line. He told me he would speak with the district manager and someone would get back to me that day or the next. No one has called me as yet. I have an answering machine, caller ID and call waiting. There has been no effort to contact me.

I am aware that Sprint owns PCS and I want to make sure your company is aware of how poorly I was treated. Had I not been misled and taken advantage of, I would not have purchased the Bluetooth and thus, would not have returned the phone.

I was a salesperson for quite some time and I made many sales and commissions without LYING to my customers. Therefore, I know the difference between guiding and deliberately misleading.

I feel I should be refunded the re-stocking fee because I was lied to and extremely dissatisfied with the way I was treated.
