SUMMARY OF ARBITRATOR’S DECISION

Complainant Woodbridge Structured Funding, LLC (the “Complainant”) has challenged the truthfulness of certain specific statements (each, a “Statement”) posted by Author Anonymous (the “Author”) on the Ripoff Report website at www.ripoffreport.com as Ripoff Report #1081963 (the “Report”). The Author did not provide a response to this matter. Therefore, in accordance with the Ripoff Report VIP Arbitration Rules (the “Rules), the Author waived their right to participate in this Arbitration. By submitting a Report and a Complaint on the Ripoff Report websites, both the Complainant and the Author have agreed to submit the dispute to the Ripoff Report VIP Arbitration Program.

In accordance with the Rules, the Arbitrator was asked to decide whether the challenged Statements were an opinion or a fact. If, and only if, the Statement was determined to be a statement of fact, the Arbitrator was asked to further decided if, by a preponderance of the evidence, to determine if the Statement was true or false. If the statement identified by the Complainant is determined to be an opinion, no determination will be made as to that particular Statement because an opinion cannot be determined to be true nor false.

In this case, the Arbitrator had only the evidence submitted by the Complainant to consider. The evidence submitted included Ripoff Report #1081963, Complainant’s Arbitration Statement, Complainant’s Witness Statements, and supporting documentation.

Each Statement challenged by the Complainant has been considered, together with any Witness Statements and Documents provided by the Complainant for determination of the truth or falsity of the Statement. The Author did not provide a response to the Complaint.

The Arbitrator determined that the certain statements challenged in the Report were false. Therefore, according to the VIP Arbitration Rules, those statements have been redacted.

I had sold my settlement twice in the past. Once to JG Wentworth which went smoothly and once to RSL Funding which also went just as they had promised.

I decided to sell the remaining portion of my settlement payments and called up both JG Wentworth and RSL to get quotes. I also had received a ridiculous amount of flyers and offers from Woodbridge Investments so I decided to call them as well.

Please note that the statements contained above in report number 1081963 regarding Woodbridge Structured Funding, LLC, are false and defamatory.

This rebuttal notice is being posted to inform the author of this report, report number 1081963, that Woodbridge Structured Funding, LLC, has initiated legal proceedings in an effort to learn the author's identity of this report, report number 1081963.  Woodbridge Structured Funding, LLC's lawsuit was filed in the Superior Court of the State of Arizona in and for the County of Maricopa on May 9, 2014, and contains claims for defamation and defamation per se.  The case number is CV2014-007814.  The Judge assigned to the case is currently Honorable James T. Blomo. The address for the Superior Court where this case is pending is: 101 W. Jefferson, Phoenix, Arizona 85003.  The phone number for the Superior Court where this case is pending is: (602) 506-3204. Woodbridge Structured Funding, LLC, through its counsel, filed and served a Subpoena on Xcentric Ventures, LLC on or about May 21, 2014 requesting the name, address, telephone number, e-mail address and IP address for the person(s) who posted this report, report number 1081963.  Woodbridge Structured Funding, LLC's Subpoena also requested that Xcentric Ventures, LLC produce any documents or writings in the possession of RipoffReport.com evidencing factual substantiation of the documents or writings contained in this report, report number 1081963.

Woodbridge Structured Funding takes all claims against it very seriously.  We do our very best to make sure all our customers are happy and treated fairly.  This fairness and honesty has earned Woodbridge Structured Funding an A+ rating with the Better Business Bureau, the most reputable organization when it comes to business reviews.

Unfortunately with the advent of the internet, unregulated sites like Rip-off Report and Pissed Consumer have allowed for competitors to post fake reviews whose sole purpose is to damage someone's business.  The above post underscores this underhanded tactic and is totally fictitious.  It has come to our attention that we have been attacked by a negative smear campaign that began on Friday Nov 30th 2012, prior to this date our company had zero negative posts on review sites.  We now have dozens of posts that were all put up the same exact day and around the same exact time, clearly underscoring these are an attack against our brand and not real consumers.  

Further the wording in these posts like the one above, clearly show this is an SEO (Search Engine Optimization) tactic to smear the brand name of Woodbridge Structure Funding.  All paragraphs begin with some form of our brand name Woodbridge, Woodbridge Structure Funding / Woodbridge Investments (our former name).  A REAL consumer would not reference our company name several different ways in their complaint, but an SEO company would to try and get the negative post to smear against all versions of our brand name.  Unfortunately, unlike the Better Business Bureau, which has a process in place to qualify REAL complaints, online review sites do not and anyone can post what they want to falsely damage a business.

Woodbridge Structured Funding takes all complaints very seriously and we defend the stellar reputation we have earned over the past 20 years.   We have pointed out to each of these sites the set of highly unusual circumstances surrounding this online attack, which now encompasses close to a dozen review sites, all with different profile names, but similar fictitious stories and have requested these posts be removed.  Unfortunately, these review sites allow posting before qualifying the authenticity of both the complaints and the persons behind them, and profit from the uphill battle to get these posts removed, unlike the Better Business Bureau which has a real filtering process.  

We thank all of our loyal and satisfied customers and want the public to know we have always and always will be accountable as a company and a leading provider of buying structured settlements, annuities and lottery payments to our customers.
