I lost 2 orders in the "seige" by our Government. The first one I can understand, but the second one was after the seige when they took my order knowingly that they weren't going to send it. I received the response to contact my credit company, which I did and they said the company must issue a refund not the bank. I used a debit card by the way. The way I see it is that Yessmaoke lost nothing in this except future sales to the U.S. All of us who never received our order are the ones that got ripped off. Yessmoke has my money, not the Government. Yessmoke had a refund policy, but they do not honor it. I was a customer for 2 years without any problems. Now they just stick it to you without any remorse. For all I know, they could have staged the whole seige and never sent half of what they claimed was sieged! I smell a rat and he's smoking my cigarettes!

I wrote one of the Rebuttals posted above (from "Lucas" in ), and I've noticed that multiple RipOff Reports have now been filed on this site regarding Yesmoke ... but this is still one of the most prominent threads of discussion on the topic. Anyway, my rebuttal listed on this page is actually a post on my blog, and I've been updating the original post with new Yesmoke news as it comes along. As for all the people complaining that Yesmoke is no longer issuing refunds, again, Yesmoke has been upfront about this for some time: They're requesting that you request the refund from your credit card company. Your credit card company should cover you, since you never got the item. So you'll get the money back. Yesmoke.ch will then get in trouble with your credit card company -- but they're prepared to deal with that. Essentially, their customer service department can no longer handle every single customer emailing them asking for a refund -- it's easier for them to deal with the major creditors instead. In fact, its probably safer, for the customer, too, since the U.S. is now trying to hunt down back-taxes on cigarettes in some cases (so getting money transferred to your account by Yesmoke might not look so good). And they're no longer shipping tot he U.S. or selling to U.S. customers. But theyre been very straightforward in encouraging their clients to complain immediately to their credit card company so everyone can get their cash back.

The tangle of sentences and convictions leaves little hope that we might be able to return to the previous situation. I orderd 2 cartons of Marbollo from this site,AND I STILL HAVE NOT RECIEVED MY ORDER.I called the phone number on my bank statement an it was the Marbollo Com..I was told this site ripped me off,that it was illeagle to sell there product on the web,that they have had complaints about this.I was ripped OFF. I've used Yesmoke for years, and they've always been very responsible. It's true that you do have to be patient with the orders -- even if you pay for expedited delivery or airmail, it can still sometimes take months to receive an order, so you must order far in advance of when you need the product. The reason for these delays is two-fold: (1) Ordinary international shipping delays, which can be expected with most products ordered from overseas; (2) Special international-customs-inspection delays due to the nature of the products (cigarettes, cigars, wine, and food-stuff). However, when things work well, sometimes even the cheapest delivery option will result in the product being delivered within just a few days. If the product doesn't arrive, Yesmoke will not refund or replace an order for several months -- but this makes sense, since all orders usually arrive eventually, and Yesmoke knows that massive shipping delays are common with their products in particular. Of the many times I've ordered from this company, there was only one time that a shipment did not arrive. After several months and one brief email of complaint, Yesmoke sent me a replacement without any fuss. In fact, they were very friendly about it. Regrettably, the big tobacco companies have been hassling Yesmoke for years for various reasons (including the fact that European cigarettes conform to higher health standards than U.S. cigs, which could open the companies up to law suits if, for instance, a Yesmoke customer did not get cancer from smoking Euro Camels, but a another smoker did get cancer from smoking U.S. camels). At first, this resulted in Phillip Morris being allowed to take (by force and court order) the Yesmoke.com website address (the company now must be reached through Yesmoke.ch). But more recently, the tobacco companies have found a friend in the NY State Government, which is angry with Yesmoke circumventing New York State and NYC cigarette taxes (through a completely legal customs loophole). This resulted in the confiscation of all U.S. shipments of Yesmoke products. Yesmoke is currently unable to ship any more product to the U.S., and the matter will likely be decided in court in the favor of the NY government and Big Tobacco. This is too bad, since Yesmoke has evolved from being a mere shipper of cigs to now being a manufacturer -- the Yesmoke brand cigarettes are similar to American Spirits and Winstons in that they avoid additives of all sorts, and Yesmoke has taken things a step further by listing their ingredients on their package and trying to create a slightly safer cig.... If Yesmoke is ever able to ship to the U.S. again, I'd highly recommend the company (although, of course, quitting smoking is the healthiest and cheapest option available, regardless).

I have been ordering from Yessmoke for over a year and have never had a problem, EVER. I have always received my orders. Problem is Phillip Morris and the gubment [sic] of the US are losing sales and taxes. If they weren't so greedy, they wouldn't have this problem. Somehow they never seem to figure out when prices become ridiculous, people will look elsewhere. Simply an attempt to demonize Yessmoke because they are cutting into the profits. I will order from them again as soon as I can. THEY ARE NO A RIPOFF AND SHOULD NOT BE ON THE RIPOFF REPORT.

I've been dealing with yessmoke for over 2 yrs and there have been delays before this but this time it is rediculous and it is totally the US goverment that held this up and we are all getting screwed...I personally could give two shits where these cigarettes come from especially since our goverment wants to control every d**n thing we do or say and take away a 'smokers' rights, we can't smoke anywhere without gettting crap about it...it's our choice if they don't like move! Anyway back to yessmoke, they have always, other than this time, made good on any problems or issues and this time they had over $500K siezed by the US goverment therefore I would expect it to take some time to reimburse all involved I mean hell look @ the IRS, mortgage companies etc they are all rip offs and we deal with them, so bare with these people and give em a chance, even though I totally agree with those of you who are complaining

The reason for the delay for november's shipment was the fault of the U.S. government. Go to the yessmoke website. Yessmoke is doing all it can to resolve this problem and they deserve a great deal of appreciation. The greedy U.S. government is once again looking for new sources of tax money... and now they are violating not only federal laws... but they have interfered with my mail. Smokers should rise up and begin a class action for violation of postal regulations. Smokers need not look to Phillip Morse for help... in fact.. I tell everyone to avoid all of their brands. They are cooperating with the government... and I wonder what they're gonna get in return? I will continue to support yessmoke in everyway possible. I doubt my message will get posted ... but it's worth the effort to set the record straight

I order from yesmoke for about a year. I had one delivery that was slow the rest arrived on time. I placed an order on Nov 5th 2004 this is Dec. 7th and still I have no cigarettes. I have emailed them just to be told to be patient. That's easy for them to say they have my $76.00 and I'm still buying more smokes because my order didn't come. There cigarettes might be cheap when you order and they arrive like they should, but when you add the cost of buying more cigarettes waiting for you order to come in they aren't so cheap. Yesmoke's is great, till your the one who doesn't get your order or your money back, then there not so wonderful.

This company seems to be very dubious - it is located in Lugano, which is in Switzerland, right at the border to Italy. Now what happens is, that a lot of cigarette smuggling is going on at that border. I could imagine, that these cigarettes which are sold on the website have been smuggled from Italy to Switzerland and that they may have been caught. It happens from time to time. I had a look at the main company, otamedia, which has its headquarters in Belize and is a company for car parts in Switzerland. It seems as they have just recently changed their address. Do not buy tobacco articles from anywhere in Switzerland - the products are usually expensive and if not, something is usually not right. Better yet - quit smoking. :-)
