Fay Servicing, LLC Returned a mortgage payment trying to force me to become delinquent on my mortgage Farmers Branch Texas
Payment was submitted by me to Fay Servicing on 3-28-2022 in the amount of $182.53, check # 7602. Check was returned by them with a letter dated 4-5-2022 stating "your account is in active pre foreclosure or foreclosure status. we are unable to accept anything less than full payment due.
Fay Servicing LLC Mortgage statement dated 3-10-2022 indicates clearly the next payment due is 5-1-2022 in the amount of $65.06 with NO indication of arrearages. I called on 4-13-2022 and after 16 minutes the customer disservice rep hung up as I was insisting to talk to a supervisor in a loud voice since she had broken English and was extremely hard to understand. I was very aggravated by this time since I was getting stone walled being told I was represented by an attorney and they could not talk to me regarding this matter.
I told them they needed to check the bankruptcy records and she kept arguing with me. This loan has had several servicers over the years with no problems. Fay Servicing took over the servicing around December 2021 and had accepted 4 of my payments in the amount of $182.53 each for December, 2021, January thru March 2022 with no problem, no mention of being behind and sending a statement as mentioned dated 3-10-2022 that next payment due was 5-1-2022 for $65.06.
My guess is that some inept untrained individual working for Fay Servicing improperly booked the loan or it is a bigger issue of predatory loan servicing. My concern is that they should be investigated to see if there is a pattern of this type of outrageous treatment of trying to place current on time paying customers into a delinquency status to perpetrate fraud and predatory servicing and subsequently foreclosing on their properties by returning their payments then when you try and call to resolve the issue they stonewall you and force you to hire an attorney.
If Fay Servicing is that incompetent in being able to service loans and can't properly document the status, then they should be banned, sanctioned and forbidden to service loans at the very least in Florida...I have resubmitted my returned payment by certified mail to the address on the 4-5-2022 letter from them. I certainly do not want my credit reporting from them to be affected for no wrong doing on my part.
Perhaps since I am over 60, they act as predators on the elderly thinking they don't have all of their faculties but I have all my records. I now have over 8 hours of my time and have suffered emotional distress and expended time and money to correct their inept actions in this matter. If I am in foreclosure , I need to see why, when etc.
since statements from them show my being paid ahead. I would appreciate any help you can provide in this matter so they don't screw me out of my property by kicking back in full payments made by myself.
