Douglas Oswald owns the home located at 2865 Sweden Walker Road in Brockport, NY. He rented the home to us back in October of 2007, told us things like he had "artesian" well water which was the best you could drink, advising us to dump RID into the toilets once a month to keep the septic system running properly, instructed us to burn all garbage in bins on the property (which is illegal in Monroe County,NY.) In January of 2009 we contacted Mr. Oswald in Texas, where he resides, and informed him that the home was infested with mice-that one of them had given birth in the drop ceiling and the blood was coming through-Mr. Oswald responded by saying "There's only 20 mice and if you don't like it I'll send the marshall up there to throw you out." Nice guy huh? Well, unfortunately for Mr. Oswald he failed to realize that I had leased apartments for quite some time and had to have working knowledge of the New York State Laws pertaining to things of this nature. There is a law on the books called "Warranty of Habitability." This covers matters regarding properties with rodent issues are found to be not safe. We contacted the Building Code Enforcement Officer-he came out, inspected the home and found many issues with it. Needless to say the "owner" was not happy because this was now going to cost him even more money. The situation proved even more costly in the longterm because we had to secure legal representation...a couple months later a horrible stench comes into the home from behind the property.....NO SEWER system-just a pipe and the raw sewage is going into the soil and into a creek which also runs behind the other residents homes who reside north of us.....so much for the RID idea! Our next concern involved the water supply-we Had Monroe County Water Authority come out and do a sample test of it-it had high levels of bacteria in it and unsafe to drink. If the house had not been condemned by the Town/County and we did not have to vacate-the County would have mandated Mr. Oswald to provide us with clean drinking water. The home remains "tagged" it cannot be rented, lived in or sold---not until Doug makes all the necessary repairs and installations. If the guy isn't in enough trouble already, 1 month after my husband and I vacate, he files a police report with the Monroe County Sheriff's Department he fraudulently states in the report that he had us evicted for damages and past due rent!!!! That's a boldfaced LIE! We never damaged the place, we did not owe him any rent and no such eviction ever took place-Mr. Oswald defaulted on the lease agreement. When he was contacted by the town and county regarding his property being condemned, he never came up-never showed any concern or involvement in the matter. We vacated on 4-26-10 and left all the doors unlocked---his daughter knew this and we also left the keys on the front porch, wasn't our responsibility-it's his property, well due to his negligence and long list of enemies now in the neighborhood apparently someone went in and took his hot tub-well Mr. Negligence himself decided to file a false police report trying to implicate us because he has a personal vendetta. Law enforcement has since been provided with a list of names and agencies who can attest to what really transpired along with official reports regarding the house itself. I believe there are Penal Codes in New York State which address filing false information in a complaint. Needless to say Mr. Oswald has dug himself even deeper in a hole if that's even possible. In closing---stay away from this person-stay away from the property-it's bad news!!!!!
