Heather Cox owner of A and P Transcription Services sought "work-at-home" transcription professionals for an extremely large project that she alone undertook via many different venues. She was subcontracted by a company who was subcontracted by another company who was contracted by the actual company. This government agency actually requested this work be completed by the company they contracted and so the saga begins.

I didn't come across Heather and her company until the last week of July on Guru.com. She "contracted" my services via an ad. As of late, I know that she actually contracted over a dozen transcribers for this project dating back as early as the beginning of July (I know this because I'm in Email communications with them).

Since Heather contracted me and more than a dozen of us, she has yet to pay us anything and now owes more than $2,000 to all of the transcribers who helped her on this project. It baffles me that she hasn't paid a single invoice in full yet. Her reason is that since she has yet to be paid by the subcontractor who hired her she can't pay us. Our view contractually is that she alone contracted us for services to her company and therefore she alone is responsible to compensation to us! In short, she should pay her outstanding invoices regardless on whether or not she gets paid.

A and P is not responding to any Emails and refuses to respond to my constant invoice reminders on Guru and PayPal.

I am the owner of A and P Transcription Services and this is in response to the report that was written regarding my company.

I would like to state that I did contract with many typists to complete a very large project consisting of approximately 181 audio hours, in the last three weeks of July of 2010.

Each typist was informed, before starting work with me, that payment would be when I got paid, as I did not have the capital to pay everyone on a certain schedule. Each typist agreed to that and I have written proof of this. Had they not of approved of that, then they should not have started work with me on this project.

As of this date, I still have not been paid by the company I contracted with for this project and the reasons are many and are outlined below.

First, the company I contracted with, Compudex, is arguing that there was a breach of contract, meaning that information was leaked on the Internet regarding this project and that typists were contacting her and the company she contracted with, which was a breach of the Non-Disclosure Statement that each and every typist signed with me before beginning this project.

Second, work was not done to specifications nor turned in according to specifications. Before beginning this project, I had asked each typist howmany audio hours they could complete in a 24 hour period and have returned to me. When notifying my client what we could do per day, I took those figures into consideration to ensure that I had enough work for each person to do per day.

I would say 99% of the typists did not return the work as required, meaning if they told me 1 audio hour per day, they were to return that amount back to me in 24 hours, proofed and ready to go to the client. This was not done. Period. I had to hire proofreaders for this project due to the typists not proofing their work before sending it over, thus not fulfilling their commitment to have work transcribed and proofed before sending to me. This breached the contract I had with each typist and breached the contract I had with my client.

Therefore, in light of all of this happening, my client has refused to pay the full amount and so I have since taken this to an attorney and we are working on a settlement at this moment.

I have never, ever stated that I would not pay the typists and this can be proven by many email communications sent back and forth. I intend to pay each typist something as soon as I receive monies from Compudex. I am a very honest and hardworking individual.

I have since been working with two very large clients on an on-going basis and they pay on time, as our contract states. I, in turn, pay every typist per our contract for work that is performed on time and per specifications and have not had any issues to date regarding this.

As far as not responding to any emails regarding this project, I have always responded to emails, keeping each typist informed of the situation, as long as there was new information to give. The only emails that I will not respond to are emails that are degrading or threatening in nature, which is what all the emails have been as of late.

I would also like to note that each typist has already been told this information, before putting these remarks onto this website, but have chosen to disregard that information.
