ON 03.09.2007 I PURCHASED A CELL PHONE (BLACKBERRY 7730 NEW) FROM THIS SUPPLIER IN ORDER TO BE DROPSHIPPED TO ONE OF MY COSTUMERS. THE ITEM HAS BEEN SHIPPED IN ABOUT 10 DAYS TO MY COSTUMER AND TODAY'S MORNING THAT IS 03.20.2007 I RECIEVE THE FOLLOWING EMAIL FROM MY COSTUMER:

"Hello,

The blackberry I purchased from you is not effectively meeting my communication needs. It was listed as new and never opened. Not only had it clearly been opened and repackaged (made further obvious by the lack of instruction manual and retaped bubble wrap) but the front had obvious signs of wear. Please advise as to where to return this to you and the refund process not only for the item, but for shipping as well. I would much rather be refunded than to go through the hassle of negative feedback and reporting you to ebay. I would imagine you would find the former solution more efficient as well. I am CC-ing my lawyer on this email as well.

Please respond with direction immediately. Thanks.

AFTER I REPLIED TO MY COSTUMER INSURING HER THAT THE PROBLEM WILL BE RESOLVED ONE WAY OR ANOTHER I CONTACTED THE SUPPLIER. THEY SENT ME AN EMAIL SHORTLY THAT THEIR ITEMS ARE ACTUALLY BRAND NEW AND THAT THE UNIT HAD TO BE OPENED IN ORDER TO BE UNLOCKED MEENING TO BE ABLE TO WORK WITH ANY CELLPHONE CARRIER AND THAT THEY WOULD AGREE TO REPLACE IT FOR ME TELLING ME TO WAIT UNTIL THEY GET ME AN "RMA#".

THEY SAID THEY WILL SEND IT TO ME BY TONIGHT BUT THEY HAVENT. WE'LL SEE WHAT WILL HAPPEN.

I TOLD MY COSTUMER THAT THE UNIT HAD TO BE OPENED IN ORDER TO BE UNLOCKED AND AS THE SUPPLIER TOLD ME IT MIGHT GOT DAMAGED WHILE THEY WERE TRYING TO UNLOCK IT (???) NOW BE AWARE THAT I HAD NO IDEEA IN WHAT CONDITION SHE RECEIVED THE ITEM SO HERE'S WHAT SHE WROTE ME:

">I appreciate you responding to me in such a timely manner. There is absolutely no way that the marks on the blackberry are the result of your supplier handling it in the unlocking process. There are many chips off of the color and other signs of obvious wear that any device will have after extended use.

I appreciate your offer to replace this device with another however I will be returning the device to you for a full refund. Please promptly advise me on the necessary steps to do so. Of course I will be in touch with shipping costs so they may be included in the refund.

"THERE IS NO WAY THIS THE MARKS ON THE UNIT ARE A RESULT OF THE SUPPLIER HANDLING IT"! THIS IS WHAT SHE SAID. AND THEN "There are many chips off of the color and other signs of obvious wear that any device will have after extended use. AS A REMINDER THE PHONE ANYONE CAN CHECK AND AS THEY ALSO WROTE ME, IS DESCRIBED AS! BRAND NEW! WHAT THEY SENT MY COSTUMER WAS A DAMAGED AND USED UNIT.

I'VE BEEN TREATHEND TO BE SUED, REPORTED TO EBAY, PLUS NOT TO MENTION ALL THE HASSLE THEY PUT ME THROUGHT AND THERE'S MUCH TO COME IM SURE. SINCE MY COSTUMER DOES NOT WANT A REPLACEMENT AS THEY OFFERED, WHO KNOW'S HOW LONG THE RETURN PROCESS MY TAKE, MY COSTUMERS IS DEMANDING HER MONEY BACK(AND MORE SIMPATETIC I COULD NOT BE) PLUS THERE IS EXTRA SHIPPING COSTS I WILL HAVE TO PAY, AND A RESTOCKING FEE OF 10% THEY CHARGE FOR "UNWANTED ITEMS" AFTER THEY ABSOLUTLY IRRESPOSABLY SHIPPED SOMETHING COMPLETLY DIFFERENT THEN THEY DESBRIBE.

I MIGHT HAVE TO REFUND HER MONEY MYSELF AND THEN DEAL WITH THE SUPPLIER OVER A REFUND WHICH WILL TAKE EVEN MUCH MORE OF MY TIME AND MONEY.

I am interested in knowing the results of your dealings with A to Z Micro-Technologies. I had a dropship sale with them 2/28/10 that was screwed up so badly I had to draw funds on my credit card to refund my customer and 7 months later I am still fighting to get my money returned.  We are talking about $1,000.


I have actually been told "they don't have a process for refunding money. They are fully automated and don't even write checks any more.  They won't even return it to the same business credit card it was drawn from originally".  There is no corporate phone number to reach someone in a position to resolve the problem outside their automated set-up. And.... They want to charge me $30 to close my account so they can research it for 2 months to be sure I haven't made any other purchases.  ARE THEY KIDDING ME !!!

Please let  me know if your found a solution.

Criminal charges... Who are you anyway??? Is dropshipping illegal and i dont??????? Ebay allow's it, there are companies and wholesalers that are legal bussineses and they been doing this for years. There's worldwidebrands which i'll take care later, who is a memberof BBB and they also encourage it. Let me tell you something. You can dropship any product as long as the product is AS DESCRIBED IN YOUR AUCTION but in that case you would have to work with the right dropshipper. :) criminal charges, dont tell me your a lawyer :)

You offered to sell an item that you never saw, never had title to, and never had in your possession. You should be thankful that you are not facing criminal charges.
