A few weeks after we moved into our new home (August 2004), My husband and I received a box from AC Neilsen home scan. We did not solicit this device to our knowledge. (At best, we think long ago we said we would be interested in having the TV rating system) In it was a homescanner where I was to log all of my purchases. I thought that I might as well try it, but upon opening it, the device did not work. Since I did not ask for nor agree to pay for this device, I threw it in the garbage along with all following mail from AC Neilsen (junk is junk, right?). Months later I get a letter from a collections agency collecting a debt of $274.00, or the device.

Obviously, I no longer have the device nor do I think I should be accountable for the $274.00 the broken device supposedly costs. I am also obviously upset and feel it is not appropriate to be sent to a collection agency. I feel that it is fraudulent for companies to send out broken unwanted merchandise and expect unsuspecting citizens to pay for it.

Unordered Merchandise According to Washington State and federal laws, goods mailed without authorization are gifts. Unless otherwise agreed, such as with some book and record clubs, when you receive unsolicited goods through the mail, you have the right to accept delivery of such goods as gifts and are not obligated to return the goods to the sender nor to pay for them. Under Washington law, goods or services are not considered to have been requested if a person fails to respond to an invitation to purchase the goods or services and the goods or services are provided notwithstanding. Before you take any action, call the sender of the goods to verify the mistake. Often someone else in the house ordered the merchandise or it may have been sent as a gift
