Tell us has your experience with this business or person been good? What's this?

This company is insane. I recieved a call from an Asian decent individual whom was very hard to understand. He left a voice mail notifying me to please call his office and I was being looked at as part of a lawsuit.

When I called the office the person explained to me his name was Brian Taylor. Mr. Taylor told me that he was informing me I had taken out a loan with Cash Advance USA and not repaid the loan. The "Federal Bureau of Investigations" was looking into this and I would need to spend between six and eight thousand dollars to clear the matter up in court. However because he seen I have good credit and I'm an upstanding citizens he could clear this loan for the amount owed. I asked the date of the loan and he did not know. I asked the amount and he said $300.

I became nervous because Mr. Taylor had all of my information including my cell phone, my address, my ssn, and other personal things including my mother's full name. I informed Mr. Taylor I did not take out a loan and he informed me that I did. I then said I will have the NYS Police look into this matter for me and he hung up.

I proceeded to my bank to report a possible fraud and verify no money was transfered to my account I did not know about. Prior to entering the bank I called Mr. Taylor again and learned the loan was taken around April 2010. I became more aware of the lie because in Arpil I had recieved my taxes for my business and had a substantial return, I was not looking into any loans.

I thanked Mr. Taylor and hung up. I then dropped the pursuit knowing I could not be sued because the company could not prove it. Later that day Mr. Taylor called me back. He again asked about the loan and what I planned to do about it. I informed him that I planned to do nothing because there was no loan. Wondering now if perhaps someone stole my identity to obtain the loan, I asked Mr. Taylor for the information again. To be sent the information I would need to set-up a payment plan with some type of account. I refused and told him to forward my papers to the court.

The next morning I called the NYS Attorney Generals office in NY where I was pratically blown off. I asked if I should be worried these people have my information and she said I don't know. I asked if I should call the creditors and she said "if it makes you feel better." What makes me feel better is knowing someone somewhere is going to do something!

I went so far as to call Cash Advance USA and explain it to them. They told me they get alot of calls and this is a scam. After looking on here and seeing the number of people almost scammed it makes me wonder how many where scammed and sent the money. I also wonder what else can I do to push this? Is there some way to press charges against these people?

Charges against who?

Who would you file charges on?  You don't have a name, as that name they gave you was false.  You have a phone number but that is to a throw-away cell phone that they paid for with cash.  Give it 2-3 weeks(if that) and you will find that that number is now disconnected.  You don't have an address, and even if you did it would be fake.  On top of that they are not even calling you from the United States, yes they have have a US number, but they are not in the US.  So with higher priority items law enforcement has to deal with, they don't have the time to deal with a case like this where the chances of them catching someone is about zero.  The best thing to do is what you did.  Let everybody you can know as the only way that these will be stopped is by word of mouth.

As for the AG, that is about as much as you will ever get out of them because they are not there to give legal advice.  And telling you to do one thing over another could be considered legal advice.

Now, while this is not legal advice I will go one step above that.  They probably don't have your credit card numbers so the chances of them actually charging on them is pretty low.  As if they had those they could just purchase things until you find out and cancel it.  However, with that said if it does make you feel better it may be a good idea to report it to your credit card company so they can cancel those and issue you new numbers.

Now, what you should do file an Identity Theft report because you don't know how they got the information.  Then with that report contact the Credit Reporting Agencies and put a "Fraud Alert" on your credit reports.  So if a company accesses your credit report in the attempt to open an account in your name the company MUST go through additional steps to verify that it is you that is actually trying to open the account.

Identity theft

#3Consumer Suggestion

It has become clear from numerous reports of this scam, that the scammers have come into posession of a large amount of personal information, including names, addresses, phone numbers, references, bank acct. numbers and social security numbers.

Most of those reporting the scam indicate that at some time in the past, they filled out an online loan application. My guess is that these scammers have obtained (most likely illegally) a large database of this personal info. While these particular scammers are only using the info to try to make themselves appear to be a legitimate collector, that does not mean they couldn't sell the info to some other criminal when they are done with it. The amount of information they are revealing on these phone calls is enough to allow anyone to steal your identity.

If you've received one of these scam calls, you should consider your identity to be at risk. I highly recommend going to the FTC's identity theft website and taking the precautions outlined there :
