As Adam Ginsberg International has violated the following UK laws and regulations I am 100% entitled to get a full refund. Adam Ginsberg and his company are based in the USA, but I am a British citizen and the course was sold in the UK, and therefore they must obey and respect the local laws and regulations. Adam Ginsberg could even have violated UK laws by entering the country as a tourist, but then going on to conduct unlawful business activities.

1) The Supply of Goods and Services Act 1982 UK

This Act requires traders to provide services to a proper standard of workmanship.

Also, any material used or goods supplied in providing the service must be of satisfactory quality. The law treats failure to meet these obligations as breach of contract and consumers

would be entitled to seek redress, if necessary through the civil courts.

 

Adam Ginsberg International has breached the contracts by failing to provide us with the quality products and satisfactory services required by law!

 

2) Unfair Terms in Consumer Contracts Regulations 1999(UTCCR)

The above regulations protect consumers against unfair standard terms in contracts they make with traders. The Office of Fair Trading, together with certain other bodies, can take legal action to prevent the use of such terms. The UTCCRs can protect consumers from terms that reduce their statutory or common law rights and from terms that seek to impose unfair burdens on the consumer over and above the obligations of ordinary rules of law.

 

It states on the Consumer Direct website that You may think that once you have signed a contract, it's legally binding, no matter what. But if the terms in the contract are judged to be unfair, you may not be bound by them. As a consumer, you are protected against unfair standard terms in contracts you make with traders by the UTCCRs.

Adam Ginsberg International has violated this regulations by including several unfair terms and conditions in the contract.

 

3) The Consumer Protection from Unfair Trading Regulations 2008; the Business Protection from Misleading Marketing Regulations 2008; Communications Act 2003.

 

The above regulations state that the Consumer Protection from Unfair Trading Regulations 2008 and the Business Protection from Misleading Marketing Regulations 2008 implement EU Directives 2005/29/EC concerning unfair business-to-consumer commercial practices and 2006/114/ EC on misleading and comparative advertising, respectively.

I was totally misled by Adam Ginsberg's sales presentations and the over-exaggerated contract value. I am also extremely unsatisfied with the company's unfair business-to-consumer practices and awful quality of products and services that were provided by Adam Ginsberg International. According to the Supply of Goods and Services Act 1982 UK, UTCCR, and the above laws and regulations I am 100% entitled to have a full refund from the company.

 

Later I realised that the contracts that I signed with Adam Ginsberg International have many unfair terms and conditions as below:

 

1) Unfair Cancellation Period Term: Adam Ginsberg International contract only gives three business days to cancel the purchase, however this does not comply with UK Law. In the UK, consumers are allowed to cancel any purchases within at least seven business days, it is a violation of UK laws and regulations. Within three business days, it is impossible for us to attend the workshop and practice selling on eBay in order to confirm the quality of services and to confirm whether his sales presentations were misleading or realistic.

 

2) Unfair Credit Card Charge-backs Term: On the contract it stated that by signing the contracts, each student agreed to no credit card charge-backs. This term is designed to take away our rights as consumers and therefore it is a violation of Unfair Terms in Consumer Contracts Regulations 1999. This is also does not comply with Section 75 of the Consumer Credit Act 1974 UK.

 

3) Unfair Refund Term: The contract states that No refund will be considered until the entire 12 months period has expired and upon review of all documents. This term does not comply with the Unfair Terms in Consumer Contracts Regulations 1999.

 



    4) Unfair Direct Debit (DD) For Software Hosting: When you sign the contracts you are automatically entering the free trial for one month for software hosting. And after this period you are automatically charged for DD of US$19.95 per month. Adam Ginsberg workshops are not immediately available after signing the course, on the contrary many of my classmates had to wait a few months to attend the first available workshop in the UK.



    As they had not attended training they never knew how to operate this software, and never used it. However, my classmates were charged by direct debit for US$19.95 every month for the software they did not use, and Adam Ginsberg refused to refund them. We were conned and even robbed.



5) Unfair Extended Guarantee: The double money back guarantee is the bait to trick you to sign up the course. I was told that I have nothing to lose, as I have a double money back guarantee, I believed in it, and this was one of the main reasons that I signed up with the course. However, I later realised I had been conned. This guarantee is probably the biggest reason so many people have been deceived in to signing up, not realising there is no free lunch.



    When I was trying to send the 10 eBay auctions each month that I launched to qualify for the Double money guarantee, their in-boxes were always full and therefore it could not go through. I had to send the emails to ask them to clear their inbox. It was a lengthy and very stressful experience.



 

Furthermore, it states that you have to send the 10 auctions every month for 12 months from the date of signing the contracts. However, as the workshops are not available immediately for training, most people were automatically disqualified from the double money guarantee. Can you see how dirty and sneaky Adam Ginsberg International is?

 

Even though you send proof of 10 auctions (10 products you have put up for sale on eBay) every month, there is no guarantee that you will qualify to get double your money back. They even hire attorneys to threaten you so they do not have to give you back your own money, why would they give you back double your money?

 

His customer care person used every excuse to criticise me that I did not follow what they taught me, despite the fact I followed every technique I learned at the workshop. Then I realised that the double money back guarantee is actually a pie in the sky.

    6) Unfair Law and Arbitration Application Term: The Law and Arbitration section on the contract states that any dispute arising from this purchase shall be resolved by California Law. However, all my classmates reside in the UK, we are British citizens and the presentations were held in the UK, the contracts were signed in the UK and therefore UK laws should be applied to this case.



 

Many people in the UK want to bring Adam Ginsberg and his company to court for justice, but as he is a USA citizen we have found that there does not seem to be any way to sort this out. Any advice regarding this would be greatly appreciated.

 

It has been an absolute nightmare since I signed with Adam Ginsberg's eBay course, it has wasted my precious time, money and energy. I also have to go through huge financial loss as well as the emotional stress of reading nasty and threatening emails from his customer service and solicitors. It is unlawful and cruel to attack their customers in this manner.

 

It is not just my classmates and I that have lost money, as you can read from ripoffreport.com by searching Adam Ginsberg, there are lots of people who have been victimised and lost their hard earned life's savings too.

 

Adam Ginsberg has been using every excuse possible to refuse to give my classmates and I full refunds, this further proves that he is not confident about his products and services and also proves that he is running a dodgy operation. Adam Ginsberg would not even dare to disclose his business address on his websites, in case his angry customers would go there to make trouble for him.

 

We all know that all the reputable companies and big department stores take their customers very seriously and we can always get refunds if we are unhappy with their products and services.

That is why we feel safe to purchase more products from them and eventually we become the loyal returning customers, who make them even more successful.

 

My experience is the opposite of this, I have received the worst products and services from Adam Ginsberg International, but they are refusing to give me a full refund and furthermore, even using dirty tricks to threaten to sue me. All of this proves that Adam Ginsberg's sales pitch, his eBay courses including the inventory system and Template Optimiser software are all carefully and cunningly designed scheme to con our money out of our pockets! It is absolutely outrageous!

 



    Adam Ginsberg has been conducting unlawful, unethical, and irresponsible activities and they are a massive danger and risk to the general public. Adam Ginsberg makes profits by deceiving us and make a living from our misfortune, financial losses and by wasting our precious time. They are ruthless and cold-blooded, avoid Adam Ginsberg and his company like the plague. It is a universal law that this kind of business won't last very long!



Any people who are reading my reviews are given my permission to publish all my reviews and reports in the press, media, the internet, blogs, books and other sources in the world without changing the contents. This is to warn other innocent members of the public. I want to prevent as many people as possible from becoming victims just like my classmates and me so they do not have to go through the nightmares that we have been through.

 

I am a person of high integrity who has a Master of Business Administration (MBA) with distinction from a genuine London university and I am someone who an speak four of the most important languages in the world fluently. Due to my high qualifications, I used to work with top executives in large corporations and with foreign ministers in London. Personally, I would not even consider wasting my time and money to make up all of this about a company if it was practising perfectly lawful and ethical business activities.

 

Overall, I was misled and tricked in to signing up with the course, which I would not have considered doing had I known the truth. I believe their terms and conditions are unfair, deceitful and it is an unfair business to consumer practice. The truth is that I am not the only person, but just one of the hundreds and thousands of victims who are looking for justice and trying to get their money back.

 



    I am extremely unhappy and unsatisfied with Adam Ginsberg's products and services and the way they have treated me and their customers. I am also furious that they have wasted my precious time and money!

    All the above proves that I am a victim of a carefully and cunningly planned and designed scheme to con my money out of my pocket. This is why I have resorted to exposing Adam Ginsberg and his company to the world and I demand a full refund of 3,071.01 (US$ 4,899) plus 8% interest per annum from Adam Ginsberg International as soon as possible!



 

Stay away from anything to do with Adam Ginsberg and his company,

as far away as possible! I am telling you this from my true experience. You have been seriously warned about Adam Ginsberg and his company. You MUST remember that if you ignore my warnings, then you will have to pay very high price for that!

 

 

Appendix: One of the Threatening Letters Received from Adam Ginsberg's London Solicitor Via email

 

Just read below, a threatening solicitor letter that my eight classmates and I received. No solicitor would even dare to sign on this dirty letter. We received several of these abusive and bully-style letters through emails from Bristows, London, they have never sent us the original letters via post. This further proves that their intention was to scare off us who were demanding a full refund, taking advantage of the fact that we are not legal professionals.

 

Dear Sirs

 

Adam Ginsberg International Inc

 

We act for Adam Ginsberg International Inc. and its founder, Adam Ginsberg.

We refer to a number of emails (Subject Header: FW: A Full Refund Request from

Adam Ginsberg International) sent by the individuals listed above to our clients and a

number of third parties dated 20,21 and 24 November 2009 (the "Emails"). We write

to confirm that you should expect to receive a substantive response to the Emails from

us shortly, and at the latest, before 5pm on Wednesday 9 December 2009.

 

In the meantime, we should note that it is a matter of serious concern for our clients

that you have chosen to circulate the Emails to a number of third parties with whom

our clients work. We anticipate that your intention was to attack our clients' business

reputation with these third parties to cause our clients financial loss as leverage to

force our clients' hand.

 

In doing so, you have published a number of defamatory statements about our clients,

and your actions may also provide our clients with grounds for complaint against you

for deliberately causing loss to our clients by unlawful means and/or procuring a

breach of contract. All our clients' rights are reserved to take this matter further,

including issuing Court proceedings against each of you in your personal capacities.

Pending our substantive response to the Emails, please confirm by return that you will

immediately cease circulating the statements contained within the Emails to any third

parties.
