I have lived 2 years in Flamingo South Beach, and I have experienced with the worst management team ever. My complaint is because there was a mistake made by Michael Marrero, a member from Flamingo South Beach Management office, when he told me that I have to send a 'move out notice' in advance between 1 month and 2 months. The Move Out Notices is supposed to give before 2 months (Flamingo just changed those rules this year 2010), and I knew it, and I was aware of that, so that is why I been to the management office every other week 3 or 4 months before the contract ends (which was on 24th June 2010). With this mistake made by Mike, I was forced to pay month to month basis from June 24th 2010, until July 14th 2010, because I gave the move out notice on May 14th 2010, after other lady called ELVIRA MURPHY, the worst rude and unpolite associate that Flamingo South Beach has, told me to do so. Now Michael Marrero is gone, he is not working anymore at Flamingo South Beach, but he was aware and he knew me since the first day I was on Flamingo, after the first year, he was told to help me find another apartment on my second year contract and he never helped me, so that's why me and my wife were living on the same apartment for another year, even if we did not want to. Now I moved out already, and in my opinion he made it on purpose, or was not capable to work on that company, by telling me other things. I was supposed to leave on 24th June 2010, and I am moved out on 14th July 2010. Since after the first year of my contract that I wanted to move, and nobody could help me to do so because I was on the contract already, and Flamingo South Beach Management Office care more about new residents, they dont care about the actual residents concerns. Now I am asking my money back, which is 1085$ dollar, that I had to pay for that guy: MICHAEL MARRERO.

I forgot to mention, At the time of moving, the person who was supposed to be checking the condition of the apartment, did not show up, he was late one day to check the aparment, and I also was charged like if I was sleeping the night of Jult 14th 2010, when my last night at the apartment was July 13th 2010.

What did your lease say about the notice requirements? Every lease I have seen says you must provide notice in writing to the landlord at a specific address  X days prior to lease end date. Some want a 60 day notice and others will accept a 30 day notice but the time period required is written in the actual lease you sign.

The employee above notes that a 60 day written notice is required.

Remember this, for any lease (or other contract) you might sign, verbal notice is not the same as written notice and is not considered notice at all. If the lease or contract states written notice, then you are out of luck if you only provide a verbal notice. You can not over ride a written lease or contract with anything verbal. I'm sorry you lost your money, but the lease you sign gives you the rules right up front.

As to the walk through, the best way to get your funds back is to make the appointment with management for the move out date, show up with a camara and take photos of the condition of the property at the time of the walk through. Make sure you turn the keys and any gate or access cards back into the landlord or management office and get a receipt for the keys and access cards. Make sure the keys are turned in on time. If you don't return the keys and cards timely, it is not considered a move out. Get a written receipt for the keys and access cards.

If the landlord does not return your deposit within the period allowed by state law (varies by state), take them to small claims court. You have the photos for evidence to show condition and the receipt to show you turned in the keys.

In response to the concerns expressed by this former resident, per the terms of his lease agreement he was required to provide 60 days advance written notice of his intent to move out of his apartment. Unfortunately this gentleman did not agree with this policy and believed we should consider his conversations with our leasing consultant about possible transfer options as adequate notice that he would be moving out of the apartment.

AIMCO Mgmt Team members take resident complaints very seriously. We are committed to treating all of our residents fairly and providing excellent customer service. Out of fairness to all we must hold everyone accountable to the terms of their lease agreements.
