Around Oct 24th tow truck guy knock on my door saying he is here to repo my car. I ask what is going on, He said I was on his list.

I called Ally to find out what is going on why are they taking my car after I put in an agreement for a re-write.

I was told I owe for Aug and I am now 90 days pass due. First of all my payments are due on the 24th so it's not 90 days pass due. 2nd of all I know I paid Aug I even made 2 payments in Aug. They did't want to hear that even though I gave them confirmation of my 2 payments. They ask me where was the car I told them it is being taken the person I was speaking to told me they were sorry they can't give me anymore info cause they are taking the car I had to call another number, I call that number and they had no info for me to call back in an hour .I been calling back every hour on the hour after 6 hours they told me I had to pay 1774 + 26.01 late fee + 400 repo fee to get car. I ask where did they get that total I was just told I only owe 763. I was told well now you owe 2200.14 and there is nothing they can do.

I kept calling Ally and finally I got someone to speak to me who I can understand. Holly went over my payment histroy and came to realize my Aug payment was paid, so I ask about getting my car back and ask why I had to pay so much to get it back, she then came up with oh well you have to pay back months ( here we go ) every  time she said I had to pay I counter her to prove I didn't. I even call on Sept 26 spoke to refinance dept they was giving me a refinance went over my account said I owe 319 of unpaid fees that they couldn't tell me what for , but ok I paid those fees and were told my account was all up to date. So I ask why did they take my car charge me all those fees and can't or wont give my car back knowing I don't owe. This is robbery and they are getting away with it. PEOPLE DO NOT EVER USE THIS COMPANY THEY ARE THE WORST!!!

I called Ally to find out what is going on why are they taking my car after I put in an agreement for a re-write.

- I would bet that the details on this "agreement" would explain why your car was reposessed. I would also bet that this story does not include the phrase "I made every payment on-time and for the full amount".

So perhaps you can give us additional details, specifically around this agreement, and if you were ever delinquent or asked for somethng like a deferment or other assistance.

Not to say that eventually you may not be able to work something out with them and get it back without having to pay any fees.  But as an FYI, until you pay off the car and receive the title, the car is NOT yours..it is theirs. As such a finance company has the legal right to reposess their car at any time they feel their security(the car) is at risk or they feel that you would not be able to complete the loan agreement.  So there was nothing "illegal" about the reposession.
