if you are thinking of filing a class action suit for ANYTHING, IT might be too late for some, President Moron signed a new bill into law severly limiting class action suits- another blow fot the people and a win for corporations. EBAY The buying and selling giant has been accused of shilling, or illegally bidding on an item without the intention of buying it. A class action lawsuit also accuses eBay of pitting buyers against themselves, and profiting from the increased bids.

This is the first RipOff Report that was filed on JEWELRYBYEZRA back in December of 2003. At that point in time Ezra was stealing from hundreds of eBay members every month while eBay allowed them to do so. It took about a year for eBay to finally take the appropriate steps and suspend JEWELRYBYEZRA. WHY DID IT TAKE SO LONG? The answer is simple. Ebay is in bed with the "powersellers" and turns a blind eye to their fraud and deceptive tactics as long as the seller fees keep rolling in. Ebay had better address this situation and SOON. There are many other frauds out there (search eBay on this site). It's a shame that eBay members feel that the RipOff Reports are their best recourse when they have been victimized by unscrupulous eBay sellers. WHY? Because, all they get from eBay/PayPal is a pack of excuses as to why they are unable to help. EBAY ... STEP UP TO THE PLATE AND STOP EBAY FRAUD!!! I predict that one day in the future, you will be severely fined by the FTC unless you take action NOW to stop the fraud.

Being only 5 hours away from where this company is located in NYC, I get the NYC news here. (WPIX, or WB11 news at 10.) They have a segment called "Help me Howard". It's a guy who goes after fraudulent businesses. I submitted a complaint to him, after doing so with the state's Atty General and the Metro NYC BBB. I have just filed a complaint with the Office of the New York State Attorney General, consumer fraud division. Here is their link: http://www.oag.state.ny.us/consumer/consumer_issues.html I urge ALL of you who have been defrauded by this company to do the same. They have online complaint forms, as well as a toll free number. The more people who file, the faster our issues will be heard and resolved. Hopefully they will be prosecuted. Thank you very much.

I am also a victim of this Ebayer! I read the negative feedback and also compared it to the MANY postives and chose to keep my purchase small. Glad I did too! Won the items 8/26/04, they charged my card 9/26/04, sent me an invoice stating it was shipped 9/27/04, but golly gee the USPS doesnt show that antmore was ever done beyond printing the label! My suggestion (since I am a paralegal) is let's get him in ways that will make more of a dent! I have already researched it! I am going to get my money back plus interest and costs, the more that do that the better! NY has laws that if he already has three or more of these suits against him unpaid we can get three times the damages! Now that little purchase doesnt seem so nominal does it?

Yeah I got ripped off by them too. MasterCraftman my BEHIND. my edbay id is drlspears and you can check to see the feedback (only nbegative I have left) for jewelry by Ezra. I gave them ample opportunity to respond before leaving feedback. I forwarded many of your comments to Ebay today August 25, 2004, for all the good that will do. I am requesting you do two things. 1) Send Jewelry by Ezra a Payapal invoice for any amount you think is fair..and whenever you think of it..just hit the reminder button... see you can do something....might make you feel better...I enjoy it. and 2) If you so choose, after my experience with them, I decided to create my own jewelry (mostly gemstone earrings) and will be selling on EBAY (or anywhere else good you recommend). I am a certified fraud examiner. Most of my earrings will be 18KGF, 14KGF or 12K gold filled or 925 Sterling french ear wires, hoops or posts, with the same headpins or, if noted; some copper wire wrap settings. I am taking great care to have some fun nice quality products, and will custom design and e-mail pics. if you like you buy, otherwise I'll sell them. I got tired of tiny earrings you can't see and stoned mounted on posts that break. I will state sizes in inches and will provide as much accurate information I have about the product. I have over 4,000 earrings...(soon as i make them, ha) and some optional nice organza gift bags or tulle circles /birthdy and other ribbon/ and elegant gift tags in time for the holidays. All sent priority or first class with delivery confirm and on-line tracking. Some jewelry companies are promoting getting into the jewwlry business with quick set findings and cast ring bands. Jewelry By Ezra and Jewelry auctioneer appear to be EBAY sellers that have adopted this. It just is not the same level of items. I have chose NOT to do that part of the business because quality is too important to me. You can have gems made by Blue Nile or Thiagems and I have no knowlege of how good that will be. Look for my shop..tell me of better alternatives to Ebay..and let's all complain to Ebay to get this bad apple removed. And send a DAILY PayPal invoice to EZRA ...say for $100 per day that your money has not been returned. A little Rip off penalty. Tell Ezra "Dr. Spears" sent you...just what the doctor ordered. This den of thieves is scamming over 5% of the thousands of people who buy from them on eBay. We're taliking about HIGH VOLUME THIEVERY HERE !!! When you get by with stealing from roughly 6000 customers every year...it just has to raise the profit margin. Besides, they don't even have to deal with shoplifters on eBay. jewelrybyezra has a GOLD MINE at the expense of the little guy and eBay turns a deaf ear to the complaints. Hmmmm ???? I ordered product from Jewelry by Ezra. I was satisfied with the first item, even though it took SIX WEEKS to get to me. I order two additional items (fair prices), but one (a ring) had considerably smaller stones than pictures and the other (a necklace) had chinks in the chain. I returned both items...in November 2003 and never got a response. I have proof they were received, but the signature was ILLEGIBLE. I tried reaching them by e-mail, and finally faxed them - six times - and still nothing. I contacted eBay and all they could tell me was that they too were unable to reach them. Thought we were being protected to a certain degree by eBay. Now, because of all this fiasco that is being created, they have e-mailed me saying they do have record of one of the items being returned and I should receive a credit in 2-3 weeks. Why so long? Hope they don't declare bankruptcy before I get my money.

Perhaps things are improving with jewelrybyezra. This sack of stinking rat turds has only 206 Negative Feedbacks in the past month. WOW !!! What an improvement !!! However, their policy of making all eBay sales "private" is very "questionable" to say the least. BEWARE OF JEWELRYBYEZRA !!!! Before you buy from this bevy of lowlifes...LOOK ELSEWHERE!!! I have read the posts for this and I am pretty suprised. I also have sold and bought a number of things on Ebay, though not of any great volume. I looked into this buyer and I have found this refund policy. Please read it and pay attention to the section that I put in quotes. This will allow them to pick and choose to whom they issue a refund. CAVEAT EMPTER (buyer beware) Your satisfaction is very important to us. We accept returns for an exchange, credit, or refund within 15 days of the item(s) ship date. Items must be in their original condition, not worn, or altered. We will not reimburse the return shipping. Any exchange, credit or refund will be for the original price paid, minus shipping, handling and 15% restocking fee unless the item is defective or not as described (Please note all descriptions including gemstone and diamond information are our best estimates). Items received for replacement which are unavailable will be refunded without a restocking fee. "If we feel that the return policy is being abused we reserve the right to refuse any exchange, credit or refund". This company has a 95% feedback rating. If you look closely at the individual entries, there are 10 to 15 in a row from the same buyer with the item they bought made private. This is really strange. If I left good feedback and am happy with my purchase, why deny others from seeing the product you bought. The only products you can see are the ones where the buyer left negative feedback. BREWARE!!!

I am amazed at how some people can always seem to twist things around and make the victim of a crime seem to be at fault. Anyway, this is a quote directly from eBay's FEEDBACK FAQ'S page. "What if a user I'm thinking about buying from or selling to has received negative feedback? If you find negative feedback comments, don't automatically discount the eBay member. Instead, * Find out the ratio of negatives vs. positives * Check to see when these negative events occured. Were they recent or did they occur a long time ago? * Did it appear to be retaliatory feedback because the eBay member left the other member negative feedback? * If the questionable feedback relates to the quality of the item, review the listing. Is the item described adequately?" EBay further adds, "It's best not to judge users only on feedback ratings." I have personally bought over $20,000 in merchandise over the past six month period. I have been fortunate enough to make, what I consider to be, some very good buys. Some of those buys were from sellers who had one or more negative feedbacks. I am certainly thankful that I did not arbitrarily discount them. In this particular case with "jewelrybyezra", my wife had purchased from them on at least one prior occasion. I followed eBay's recommendations, to the letter, regarding sellers with a negative feedback profile. My question remains the same..."WHY HASN'T eBAY SUSPENDED jewelrybyezra ???" I am convinced that it must be because this seller is the source of big profit to eBay every month. Let me also add that "jewelrybyezra" has evidently defrauded a large number of other eBay members during the month of December. I have personally received many emails from eBay members askingfor advise on what to do about these carpetbaggers. WHERE ARE YOU eBAY ???? I, along with many other members need your help !!!!!!!!!!

you would think with all the negatives this bunch has that it would throw up a red flag to you. i agree they should be suspended but this is as much your fault as theirs because you did not do your research before you bid. Always on ebay auctions research the seller and if they have more than 1 or 2 negetives then move on and do not buy from them
