TALLAHASSEE, FLAttorney General Bill McCollum today filed a lawsuit against a Palm Beach County company alleging deceptive trade practices involving timeshare resales. According to the lawsuit, American Marketing Group, LLC engaged in a systematic pattern of conduct designed and intended to induce consumers to pay an upfront fee for their timeshare resale services through a series of false and fraudulent misrepresentations.
The Attorney Generals Economic Crimes Division began investigating the company in November after receiving numerous consumer complaints. American Marketing Group, LLC allegedly used telemarketing to entice consumers to use its timeshare resale services. According to reports from consumers, the company claimed it had a buyer for the consumers timeshare, the timeshare would be sold within 120 days and if the timeshare did not sell within the 120-day period, the consumer would be refunded the upfront fee. The company then provided the consumers a written contract containing completely different language than that which was previously agreed upon by the consumer. Additionally, consumers who complained to the Attorney Generals Office reported that the company has not performed the promised services and that they were unable to contact the company or get their promised refunds.
The lawsuit seeks a permanent injunction prohibiting the defendants from engaging in any timeshare resale business in the State of Florida or out of state involving Florida businesses and residents. The lawsuit also requests full restitution on behalf of all victimized consumers, civil penalties, and reimbursement for fees and costs related to the investigation
