After finding this website and reading all of the complaints against America's Servicing Company (ASC), I am terrified at what others have experienced. I didn't figure I was "alone" in my dissatisfaction, but I had no idea what may be still be in store for me.

The servicing of my loan was transferred to ASC on Nov 16.In accordance with letter sent on Oct 28 by my previous servicing company (Select Portfolio Servicing, I made my Nov payment to them on Nov 7. They would transfer the payment to ASC on Nov 16.

On Nov 22 I turned on my cell phone and heard 2 voice mails frm ASC one at 810AM and the other at 1130 AM, requesting that I call them, which I did. I was greeted with "hello, this is a Welcome call. We are now servicing your mortgage and we have not as yet received your Novemeber payment. This is an attempt to collect a debt". I said of course i didn't send it to you, it went to Select and it should be in your possession by now. I can only say it was paid on time. And according to RESPA, you can't charge me any late fees.It must be in the transioning from the other company to your company. And do not call me on my cell phone again- and I gave them my home number.

Well, at 812AM the next morning, I got another "welcome- this is an attempt to collect a debt. Your payment is late" call. So I asked for a supervisor. Got a guy named "David", who told me it was illegal for them to call the previous loan servicing company and that I would have to prove I paid it to them. So I got a copy odf the transfer from my bank showing the funds withdrwan and paid to Select on Nov 5 and faxed it to him. David also told me that America's Servicing Company is a subsidiary of Wells Fargo Bank.

On Nov 24 I received 2 more "welcome" calls and Ihung up on them, but sent a fax to David saying "cease & desist" from harrassing me. They must have the payment somewhere.

Nov 25 was Thanksgiving and ASC employees had the day off.But have no fear--at 5:30 PM Nov 26 i received another harrassing "welcome" phone call, telling me this is an attempt to collect a debt and when do I intend to pay my Nov. mortgage. I asked for a supervisor, was put on "hold" and finally hung up to finish cooking my dinner.

Saturday & Sunday were quiet-if I saw "unknown name, unknown number" on my caller ID, I didn't answer the phone.But again on Monday the 29th, the phones rang. I sent "David" another fax asking them to stop harrasing and a copy of the RESPA regulations.

I called my bank who assured me the check had been cashed- but not until Nov 19, and I requested a copy. I received it on Dec 02. I called Select- the previous servicing company, faxed them the cancelled check and they said they wqould look into it from thier side, but she said in all likelihood, ASC is the party who cashed it.

From what I could tell, the check was mailed to Select by my banks' electronic bill payment service on Nov 7; Select received it on Nov 12. Someone processed it on Nov 17 and again on Nov 19.

I tried numerous times on Dec 02 to speak to a human being at ASC. I first had to enter my loan acct number into the automated voice, which sated no such loan exists with ASC. I then used the SSocial security # option- it worked and the automated voice said my payment had been received on Nov 26. I then got a human aand then asked for a supervisor.

The supervisor said those were "welcome to ASC" phone calls, not debt collecting. I said I only needed ONE welcome phone call and all of the calls were harrassment calls. I asked why they received the funds no later than Nov 19, didn't credit my account until Nov 26, and even then I continured to get the warm,fuzzy "welcome" harrassment calls. She couldn't explain it, but I will say that she was very nice and tried to be helpful- Maybe it was her first day of employment with ASC?

I sent a fax to Sandra Bondarenko, Asst VP for America's Servicing Company, telling her how thrilled I was that ASC was now handling my loan and how I pray someone else will buy the servicing of it in the very near future. Her toll-free fax number is 866 453-6315. I doubt I will get a response. I am certain I am now "marked" and there will be repercussions.

After reading other compalints against ASC on this website, I am scared, I am terrified. And it doesn't look like complaints that have already been filed with the Atty General's office or other government agencies are getting any results. This company sounds very dangerous. They disguise Harrasment calls as "welcome" calls in order to flaunt the law.I have now learned from reading some of these complaints that ASC is not always paying the taxes & insurance they are "escrowing".

We are the lambs being led to slaughter. We cannot control what they do- they have the power to ruin us. Apparently they can do whatever they want and get away with it. They are either totally incompetent or criminal, or both.One writer may have been correct in saying they want to create a foreclosure situation, as most of our homes have escalated in value over the past 18 months.

I will contact the appropriate agencies and file complaints against them. Perhaps if we all do so, our voices may have the slightest chance to be heard.
