Americas Servicing Company; American Services Company Sold home right out from under my 86 year mother Portsmouth Virginia
In October 2005 My mother's mortgage payment was increased from 712.00 to 964.00 on a fixed rate mortgage with no explanation. The only change was a 220.00 plus increase in the monthy escrow for insurance and taxes. My mother was exempt from taxes but ASC continued to use bogus tax estimates to increase her monthly payments. principal and interest payments were made without the increased escrow amount.
A lawyer acting as trustee for ASC mislead my sister who was trying to resolve the issues with ASC and proceeded to sell the house at auction and attempt to evict my sister based on a court decsision naming my father who has been deceased for 20 plus years. My sister who lives with my mother has been to court several times and was forced to pay a $2,000 bond to appeal the sale of my mothers home based on what we believe to be bogus information. Attempts to contact and resolve the issue with ASC have been futile.
The bogus sale was done in July this years and my mother health started to fail drastically after that and she passed away in early November this year. I believe that the stress of being evicted from her home of over 27 years had a direct impact on her health and her eventual death.
In June of this year after waiting months on ASC to correct the escrow errors, a new escrow statement was received indicating that the new mortgage payment would be $688.00 with an escrow excess of over $2,000.00. Even with this information the trustee proceeded with the sale. Legitimate payments for principle and interest were returned for no good reason.
We believe the trustee's actions to be intentionally misleading and unlawful and he used the courts to further this rip-off. We have not found any lawyer willing to help but we will not rest until the matter is resolved appropriately.
