I have been with ASC since Mila sold me over Sept of 2004. In no way does my tale make me faultless. If it was a faultless thing i would not be in the snafuu that i am in.
By October of last year my husband had been laid off his employment and trying to keep up i paid 50%-75 % of the loan for the next 2-3 months. ASC was constantly aware and they thanked me and said i was not being charged any late fees, and were very kind.By the 1st of the year things had not gotten better so i was told to set up a repayment plan to get the money back in and stay on track. I agreed to a payment arrangement of $1400, and awaited the documents to sign.
Upon getting my 1st payment slip it was for $1900 a amount that was not aggreed upon and i called to try and fix the mistake. The very green customer service agent was apologetic and we set a new plan in motion. This happened 3 times and i never got anything in writing.
So basically to ASC i had broken 4 repayment plans and i was to blame.i also found out all this time they were charging late fees and reportnig to credit bureaus ( things they said would not happen ). Just as a side not.. i made all payments by phone so i would have a confirmation....some would post 10 days after the fact.
So by March 2005 i have been dealinhg with collections, and now they send me to loss and mitigation to reagree to a payment plan which will be faxed asap for me to see agreee and sign. The loss and Mitigation specialist told me for what i owe i wouldn have to make a down of $3500. Not knowing where this amount came from i questioned it and told him no paperwork i had equalled this amount. Of course he acted very simpathetic. He put me on with another Mitagation specialist who told me inmy situation and with my homes value increasing i could do a Modification program for my loan.
For those of you who don't know a modification takes the money you owe and puts it back into the loan . Then my original payments of 1100 would have been $1175.
I was really excited about this plan and got ALL the documents in order ( letter of hardship, fiancial worksheet, paystubs for both of us, bank statements, etc ) and sent them with a $1200 deposit.This was March 17th.
I called 2 times weekly to see the status. Every time i called it was in review, but all documents were in and i was so diligenmt they would most certainly approve this ( this is what they are telling me ). This went on for 3-4 weeks and i called 3-4 times weekly.
Every time i would call i would ask if i should still make payments to the account. Everytime i was told no, because there would be a approx $3000 down to complete and save my $$.
Ok, we are at mid May now, i get a call. Asc is saying we have not recieved your pay stubs,or finacial worksheet. Can't complete until you send. I of course told them on what dates ( since there are soooo many ) that ASC has said they have everything. I again send via certified mail...again, and faxed 4 times. June 1st i call and ask if i have payment yet, so i can pay now. i am told no, but will be REAL SOON>
June 10th- went to a real estate friends house. She asked, why is your house for sale on a forclosure site. WHAT!!!! FREAK OUT
Called ASC, oh yes it was put on forclosure 5/27/05. Because I had cancelled the modification....WHAT !!!!!
ASC backtracking, very upset, must be a mistake. I say well then let me pay now. They don't have a totol owed and they sugest the modifcation again. DO EVERYTHING ALL OVER AGAIN sent out 3 certfied copies, and 5 faxed ones ( not joking ) got confirmation on all. Will take 45-60 days for approval , save money told not to pay any now ( i have been asking to pay since April ) Both have jobs, want our house secure.I have called them every other day for updates, each time its still pending... getting sick and scared.
August 1st rolls around...nothing.Finally get a call from the person working onmy loan,whos name was kept from me and i could not call.
She is very sorry for all the time and effort put into this by me because... I DON'T QUALIFY FOR A MODIFICATION. WHAT THE $^&(&*&) !!!. With attorney fees (what attorneys ) and late fees, and blah blah fees i now owe $14,889.
The only thing i'm able to do is pay half (i paid $6000) so they stop the forclosure sale. She tells me everything i was told by previous mulitple people are wrong and uneducated. I tell her her department of mitagation is the recommendees. Nope she says , only she could give me the right track. Thanks for that.
So now i have $1900 payments that are almost going to be impossible to pay with all the other bills, my house is on suspened forclosure and the little one is screwed. I have asked for documentation of all conversations, notes, computer transactions,names and payment history for my knowledge. i am told i am not intitled to it.
I want to sue and get away from this company. They want this house. Any help please!!!!! i know i was wrong to but not to deserve this, i have been WILLLING TO PAY!!
