My mortgage was transferred to ASC in January. They did not notify me of where to send my payment or send me payment coupons or a loan number. My previous loan servicer provided me with the address to mail my payment to at ASC.

This was their first violation of the law. They were supposed to provide me with all of that information. Next, they cashed my check and didn't credit my account. I have talked with them 15 times since early March. I've sent them proof of the check clearing my bank account. They sometimes admit to looking at an electronic image of the check and sometimes not. They sometimes admit they cashed the check and say they mailed me refund check (i never received it).

Everyone gives me the run around and lies and says my account has been credited, it will be credited within 24 hours, 2 days, 1 week, whatever... they'll take care of it but they don't, etc. etc... I've filed a complaint with the FTC, the Office of the Attorney General in Maryland, and contacted my lawyer. Very irresponsible staff and very fishy company.

It looks as though ASC may have possibly credited my account for the "lost payment". The issue may be resolved. I will have to wait to receive my next mortgage statement and check my credit report in a month or two to be sure.

I've filed complaints with the FTC, Office of the Attorney General in Maryland, the Baltimore BBB, my state's Department of Commerce Market Assurance Division, and sent a qualified request letter (under Section 6 of the RESPA) via certifed mail w/ return receipt requested to the three addresses I have for the company. They still have not credited my payment to my account. As far as I'm concerned, as it sits right now, they've stolen d**n near $1000 from me since they cashed my check and just took it without applying it to my loan. THEFT!
