What a bunch of liars and incompetent morons.

I sent my payment online thru my bank. The payment cleared the bank but ASC said they didn't get it.

I made a 3-way call with my bank, me & ASC. My bank sent them certified e-mails to show that the payment had cleared. Long story short we went through hell with them calling me incessantly threatening to start foreclosure.

Now the next payment was due, they still hadn't found my payment, the calls kept coming & they said go ahead & send your next payment. So I did that.

You guessed it, they lost that payment too.

I spent the better part of each day on the phone with these people & I don't think anyone even bothered to actually look for the payment.

Finally they put me on hold & I had had it. I have health issues & I was a mental & physical wreck. I thought maybe when they put me on hold they could still hear me so I said to my daughter, "I have had it with these people, I'm just going to call my attorney & have him handle this".

Now they come back on the line & say they'll get back to me. Finally next day they call & say they have found the payments. They went to a previous acct that I had that was closed. Mother of God, they told me that they would not report this to the credit bureau but those lying SOB's did. I have never missed a mortgage payment in my life.

So here we are Sept, 07 & I find out that I was a victim of predatory lending. I am a Senior Citizen, a Realtor & the bottom of the Real Estate Industry is going down the tubes. Homes are just not selling. Hence,I have no income. So My Daughter-in-law to be is a loan officer & she has found me a loan that will reduce my payment by $800 per month but, I still have 3 months left on a prepay. ASC says they can't work with me in adjusting the prepay until the prepay period is up. They are unwilling to work with us.

I feel that ASC is a predatory servicing company. All the stories I have read about them is totally horriying.

How is that possible? Its possible they could be servicing a loan that was originated by a 'predatory' lender, but they didn't create the terms of your note. They are bound to the same note as you. If you don't want to pay a prepayment penalty, don't take a loan with a prepay penalty. Always make sure you read and understand the guidelines of the note before you sign it, if you don't like the terms, walk away.
