I used to work for Peoples Choice Home Loans and they laid me off 3 weeks after giving me my refi. They sold to America's Servicing Company and I fell behind on my mtg since I had no Job. I had a knock on my door from a stranger asking to buy my house since there was a forclosure in public records.

I have never been served by ASC and when I found out they called to work out a payment plan which I agreed to as long as I received it in writing. The 1st amt was 1400.00 but I never rec'd paper work and they told me they would not email or fax. The second call was 2900.00 which I did not have but still ask for paper work.

They would not email or fax and still nothing. Now they are telling me 7k and still no paper work. I have not been served any thing. I have sent three checks and all returned to me.

I had a knock on the door from a stranger telling me the sale date is 11/28/04 but I still have nothing from ASC. They call every day but when I am able to speak to them they put me on hold for over two hours and never pick up. I only have a cell phone so I hate to see those charges. The stranger told me the attorneys name handling the foreclosure and he is not even returning my calls. What do I do???? I love my house

Suggestion for handing your forclosure

I have many years experience working for a different mortgage company, in the default area. I see many homeowners get themselve deeper in the hole because they refuse any action until "they see something in writing". In some cases (depending on the state) the homeowner will not served with anything in the foreclosure process. I would suggest reading the details of your note. It outlines everything the mortgage company is entiled to do in the event of default. Also, many companies are allowed to set up verbal payment arrangements with homeowners. This verbal agreement often saves time and enables the loan to become current in a timely manner. If foreclosure has not happend already for this homeowner I would suggest if the mortgage company is still able to offer you a payment plan, take it!
