AMERICA'S SERVICING COMPANY FAILS TO POST PAYMENTS ON TIME - CHARGES IMPROPER LATE FEES RIPOFF LOS ANGELES California
I am an attorney in Los Angeles who just got done with my, and my wife's, own personal case against ASC, which is a wholly owned subsidiary of Wells Fargo Bank - while we made payments by personally delivering them to the address on the payment statement [a post office], it took ASC 2-4 days to post the payment. They also made calls, constantly, after the "due date" [first of the month] but before the grace period when the payment was due without a late charge [16th of the month], asking "where was my payment". I filed a complaint, expecting that they would call and try to work with me to correct the situation - instead, they hired the Sheppard Mullen firm in San Diego, an attorney named Erik Bliss, and did everything to run up the costs of the litigation and othing to cooperate - I spent about $10,000 in my own time and I'm sure they spent 5 times that. They stopped calling, but never reversed any of the late fees - I finally, due to mainly just being tired of their constant legal manuvering, filed a motion for summary judgment - they countered with 2 of their own motions and volumes of paper in opposition. I eventually, without having the motions heard, agreed to settle for $2500 and sign a release. Someone needs to take this to the limit and I'd be happy to help.
