Americas Servicing Company will systematically harrass you daily through phone calls and letters. They will call you upwards of at least 5-6 times and more a day. I also received five letters from them in one day.

They love to threaten you with foreclosure and they start calling on the first of the month for the mortgage that is due on the 16th of the month!

My loan is serviced by ASC also. I am not late and I am not in foreclosure, yet I get calls almost daily during the grace period also. I have perfect credit and am self-employed for 20 years, so I don't know if that makes me a sub-prime borrower or victim of a loan package sold to a sub-prime service company. Every month I am forced to send my payments using UPS to prove delivery of timely payments. I have been billed multiple times for late charges when the payment was clearly delivered to the correct address and on time. Multiple calls and written requests is how I have been able to reverse the unjustified late charges. This is harassment, regardless of legality, to call someone who is within their grace period daily for a payment already submitted, but not yet processed. I certainly don't want to reward this company's action by sending in the payment prior to the due date, so now I intentionally time my payment to arrive on the last day of my grace period and when they call I tell them that! I recommend getting a free on-line phone number or have them change your phone number to that other number. At least you wont hear the phone ring.

That explains their harrassing calls. However, you are wrong, your payment is due on the 1st, not the 16th. The 16th is the last day you can pay before you are considered late. They can call all they want and it's legal. It may not be right, but they are sub-prime lenders, ( and people in my opinion), and they want to be dam sure they get their money. And, beings that you are in or close to foreclosure, you are way more than a couple of weeks late, or have been a few times in the past. So, why are you considering this to be a ripoff? If you don't pay your bills on time, you can expect calls from your creditors until they are paid.
