In the process of refi with another company, Ameriquest refused to give the new refi company the payoff balance unless we paid them $60.00, the new refi company was able to obtain the payoff balance on the mortgage loan we did with Ameriquest in 2000.

When the payoff check was mailed to Ameriquest, it was returned to our new refi company requesting a $4,000 prepayment penalty plus the prepayment. Teh new refi company rep stated that she has never dealt with people so nasty and ill-tempered. When we searched our Ameriquest mortgage papers for a prepayment penalty, bam! there in little tiny letters, the company may request a prepayment penalty.

Anyone comtemplating doing business with this company, DON'T. Anyone knowing of a class action suit against this company plz post email address on this site, anyone who can help us out of this horrible situation plz do same. thanks

I only wish to say that as a consumer it is my duty to read all print, including the small and hard to find. But tell me how I do that on documents not included in my loan papers and later found to have a forged signature on them!

Nobody just slaps a prepayment penalty on you with out it being disclosed. you should have read your Note and Truth in Lending papers, as well as about 3 other documents in your loan package that mentioned this and how much it will cost if you decide to pre-pay. Shame on you for not reading these papers, as they pertain to the most expensive thing you will most likely ever own. How is it that some people will drive 5 miles out of their way for cheaper gas prices or groceries, but not read the financial papers of their refi loan? Furthermore, now that you are faced with paying the PPP, does it still make financial sense to move forward with your refinance loan? People should only refinance if they plan on being in the house, or their loan, long enough to recoop the closing costs that will be charged.
