NOW TO THE ORIGINAL REPORT THAT WAS FILED

During the sale of the system, representative promised that disconnecting from our current contract would be "easy" and that they would assist this process. Monthly service fee of $44.99 was "guaranteed" for 60 months. No mention of the fact that I was signing a 60 month contract, and that a premature cancellation of the contract would result in my being charged "a prevailing disconnect fee." The amount of this fee was not presented, but on requesting cancellation, I was told it is the balance of the contract: $2000.00 Disconnecting from the prior server would also result in a "fee": $666.00. So much for that being "easy" and facilitated by APX. It is my belief that the sales representative totally MIS-representated the details of what I was signing, and that in reading the language of the contract, find it to be unacceptably vague and open-ended. And unexplained.

Specifically, no mention of the length of the contract or the amount of the disconnect fee, details that would have convinced me NOT to sign.

Now, despite being reassured by phone that our monthly payment is stopped, it continues to be drawn. The company is resistant to removing their equipment until the fees are settled. I feel I must cahnge my checking account entirely in order to prevent any more withdrawals by them.

Their only other option for cancellation is to "transfer" the service to another household, that being MY responsibility. Why would I attempt that with a service with which I am entirely dissatisfied...? Can't they do that with their next new contract? Totally unacceptable.

I have since filed complaints with APX, the BBB of Utah, and State of MN Attorneys General. Next, I will locate a lawyer.

Hello Patrick, I just went through the same nightmare. Ultimately I won with the help of the Utah Consumper Protection Dept. but I must have written the equivalent of a Harry Potter novel to as many websites and gubment departments as I could find. I ended up closing my checking account and opening a new one to prevent any more money from being withdrawn. Tomorrow, 6/26/08, APX is 'supposed' to have an (un)installer at my house between 9 and 11. Hopefully they don't mean 11 pm! If you didn't cancel in writing, postmarked as a minimum, within 3 days, I'm afraid you're battle will be alot tougher than mine was but NOT impossible to win. Their D2D salesmen spend 7 weeks in exhaustive training learning their 'craft' and how to get around objections. I wasn't told anything about a 3 year contract; only about a 60 month. Then again, they told me the alarm was "Totally free..." for keeping their signs on my corner lot for that amount of time. And you're right. Not one word was said to me about early termination fees either. I don't see how that's enforceable but cell phone, cable, satellite TV, companies all get away with 'knowing where there money is coming from in the future' also. Stick to your guns and keep writing. If you go to YouTube you'll see that APX has infomercials posted. Post one of your own counter to their 'spin'. Then when anybody Googles APX or searches YouTube for APX....up will come your negative video. APX won't allow that to go on long. I wish you luck and I hope anybody Googling for APX BEFORE signing their Devils Compact will see our messages and kick the salesmen out of their towns.
