Reposession at 41 days past due!!

As I am writing this (July 31st) I am only 41 days past due on the June pmt due to commission only job and slow earnings in previous 2 mos due to mortgage law changes.

In less than 2 weeks (Aug 13th), I will have enough money to bring the account current, and possibly make an additional payment, but they would not work with me. When I get paid August 13th, I will not even be 60 days past due, yet they want to repo my car!!

I spoke to Chip Rorie X 1454 and his supervisor Chuck Russell x 2890 - they would not work with me. I even offered to do a check over the phone to post on my payday!!!!! Again, I would not even be 60 days past due.

They would rather repo the car, sell it for less than what's owed, and lose money. I would have a default against me. Seems like everyone would lose!!

As a consumer I would not have an opportunity to catch up my payments, needless to say again, I will not be 60 days past due when I get paid.

Today (July 31st) I also received my 1st written correspondence from Transouth that they have to have payments by July 28th!!

Thank God my parents were able to help me out and I will pay them back on Aug 13th, but this is RIDICULOUS!!!!

41 DAYS PAST DUE AND THEY WANT TO REPOSESS MY CAR!!!!!

It was a great suggestion to say call the company before they call you....with most companies I'd say that was true.... Transouth is not one one them,, I too had a run in with them..THEY ARE VERY RUDE!!! And you can call them several times a day to make arraingement but they'll still call you and ask again as if you've never called...Every associate asks the same questions as if the earlier information you gave them in NOT in the system..please (they say your even recorded for quality, wonder who reviews the quality part) why they call even after you've called them, do they think your sitiuation changed in 20 mins from the last time they called,,, Nothing promising payment or reasons why you cant pay will stop the harrassing calls from Tran South i think the Arcadia part is even RUDER... Even if you tell them that,,,example: I'll be making the payment next week on Friday the whatever... they say well we are still going to call till the payment is made... my suggestion is to clearly state that they are harrassing you and that it is illegal to do so and that you have caller ID, so you know how ofter they call. I did that and the calls minimized... finially i changed my home number and the calls stopped completely... funny thing is, they had other numbers to reach me and they weren't put on to the auto dialer. I'm thinking they dont know when the call dosen't actually get through or they are just so big that no one is in charge of updating the number but the person you first talk to who asks your current phone number. Give them some number to call and make your arraingement with them buy calling them and them not calling you... good luck ---no matter how much is owed it is NEVER ok to treat someone rudely, it doesn't make money come out of no where!! in fact it makes me not want to pay even when the money arrives.

Listen that is really illegal and check with the laws in your state. Many of these people who works at this business doesn't even know the law. Send your payment certified return receipt for proof of mailing. Keep copies of your letter you write to them and if you never got a extension you can get that. This lien holder should try to work with their consumer instead of harrassing people when they know so many people has lost jobs or took less paying jobs to survie in this crisi going on today. Many of these people don't know the business law. Go to FTC web site and then file a complaint with the FTC. It was a new law past that is federal and they are governing these companies for all racketerring activities as of this. The more complaints people filing that is when they look off into these crimes. Many of these CEO are going to prison for all this illegal acts. When ever you write a collector, or creditor they can't continue to harass you. Send them a copy of the law. If they continue the behavior you can sue them even if you owe them. Use every law because if it was that individual owing a company you work for they surely wouldn't want you calling them. You know many of these company are using Western Union to collect their payment when they do check or payment by phone and that is being done by a lot of illegal immigrants working at these places for cheap labor and they defiant don't follow the United States laws. They don't even know them in the first place. Please check out that web site. FTC is Federal Trade Commission.

Gene, I understand you were in a tight spot and had plans to bring the account current, but it is within the legal rights of the finance company to repossess the car well before the 41 days you referred to. In many states, a right to cure letter must be sent (giving you a certain period of time to bring the account current) but in other states, your car can be legally repossessed if it is less than a week past due. Arcadia Transouth as I recall is a subprime lender, meaning they finance people with spotty or limited credit. By nature, these loans are riskier than perfect credit loans. If your car has a high wholesale value, it financially makes sense in the big picture to repossess this collateral fairly early in the process, since many of these vehicles "disappear" or go into hiding the further past due they get. The only solution I could recommend for next time is to take a proactive stand. Instead of waiting for the finance company to call you, call them - advise of the situation, state your clear intention to pay on a certain date. Many lenders (even subprime) will "extend" your loan (put two payments to the back) if you have had the loan paid on time for the previous year. Your payment record is everything there - if you have a history of being past due, you probably won't get the extension. Good luck in the future!
