On November 26, 2003, I phoned aspire card because I noticed that since aspire bought Providian our interest rate was increased without the option to cancel account.

I called at 7:03 pm est and spoke with a woman named Senan. I asked her why they raised my interest rate without my knowlege. Senan replied, "We had authorization and approval to do this", when asked by whom she replied, "By you". She claimed she had my signature stating this fact. I asked her to fax me this signed paper supposedly sent out in Sep. 2003. Now keep in mind that they were bought by Providian approx. around Sept. 2003. We never received monthly statements from them until November.

When I called at an earlier time to ask why I did not receive my statements, I was told that I should use my Providian statements because they were not sending them out at this time. I told Senan that not only did I not receive this letter but I had never received a statement until Nov. 2003. When she realized she was caught in a lie, she refered us to a supervisor. The supervisor Manu, badge # 015535 changed the story. His story was, there was no signature on file but they sent a "Change of Terms" letter by US mail.

If we ignored this letter, they had the authority to change our account, but if we replied, they would close our account at the current rate. This sounded fishy. I was under the impression to change a contract you needed a signature. You need a signature to open the account and accept the terms at the time of opening. It seems to me this is a win win situation for Aspire. They do not have to prove they sent anything and can change my account at will.

In closing, I never gave them a reason to raise the interest rate. I was never late with payment and honored my end of the contract.I went from a $2000 beginning limit to almost $9000 limit in 2 years. I was a great customer. I made them aware I was going to pursue this and it did not seem to bother him in the least. If someone could advise us on how to proceed, I'd appreciate it. I believe this may be illegal but I am probably wrong.
