Margaret, First of all RELAX, I can guarantee you that they do not have you or anyone else under surveillance. Asset Acceptance are lowlife debt collectors and JUNK DEBT BUYERS. Rule #1: NEVER speak to ANY Debt Collector on the phone. Demand that everything be in writing, and you only use certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. Now, go to FTC.gov and read and print both the FDCPA and the FCRA. While on that site, file an online complaint against them for each violation of your rights. keep in mind that the FTC does not do individual enforcement, but your complaint adds to others that will eventually bring enforcement. Now, as per your rights under the FDCPA, and by the means above, send them a CEASE COMMUNICATIONS request. If they violate this, you can sue them for up to $1000 plus costs. You can also file a nuisance report with your phone company and the nuisance call bureau. If you are over 62, this harassment escalates to an offense against the elderly and in some states is a felony. The statute of limitations in Indiana ranges from 6-10 years. Credit cards and oral agreements are 6 years, and everything else is 10 years from date of last activity/first major delinquency or charge off.
