This club consisting of shady salespeople and 'look the other way' executives promoted and then sold 3 year contracts at a specified rate with the promo of a friend gets a free 1-year membership. 2 months after the fact they cancel the free membership (with no forewarning or contact)and only after investigation by the ripped off customer did they come up with the 'oh, that saleperson didnt know what he was doing' routine. They stated he had been fired, and that the bonus membership was null and void. Sorry.

In addition, the membership specifics (which days it was valid for, what classes and such were included) changed after the fact. Now, the original member is geting correspondance from Baly's saying that 4 months ago her membership was used incorrectly at 87th street and is now cancelled. Interestingly enough, the $ is still being drawn from the bank account. Get your s**t straight Bally's.

perfect case for small claims court

This is a perfect case for small claims court. They clearly defrauded you on the bonus membership. As for the 'unauthorized use' why wasn't the memebrship card checked at the front desk. You could have then been told you could not use the club that day. They'll look VERY bad in court. Also, let the local newspapers know you're taking them to court and on what day. They'll probably send a reporter over to cover it if it's a slow news day. Quite honestly, I think if you file the paperwork Ballys will back down. They can't risk the exposure. Go get 'em.
