Last year on Oct 08,2009, I emailed Bank Of America Chariman -Ms Barbar and asked her assistance to modify my loan as we were behind 2 months on our mortgage for our residence located at 1820 S. Almansor Street, Alhambra, CA 91801. The next day I received the call from Mr. Sergio Allarcon who asked me to fax our documents need for loan modification. After I faxed its, I was referred to Ms Jolene Clark for negotiator. Between that time, I still continued my mortgage payment as $3,010.22 per month. On February 2010, Ms. Jolene Clark called and let me know my loan had to be impound for be modified. I accepted it so the payment will be $3,357.93 and Bank Of America started pay the property tax and property insurance for us.

On April 2010, I received a contract from Bank Of America as Home Affordable Modification Trial Period Plan which I was been instructed to pay $3,043.22 every month for 3 months. I continued to pay and never put attention on the statement which was listed that my payment should be $3,357.93 per month. I called several times and the Hot Team always advised me to continue to pay trial payments as my loan was still on review. Suddenly on Sep 27,2010 , I received a letter from Bank of America denied my loan modification. On Oct 01,2010 I received a certified letter from Bank of America asking to pay $11,134.49 as a Notice of Intent to Accelerate. I called the bank and complained as why I had to pay that much since the beginning of loan modification review, I only owed two months which is  $6,020.44  . I paid  every month as scheduled.but why it now is $11,134.49. The customer service then explained to my son that is because I should pay $3,357.93 but since I only paid $3,043.22 so when I paid every month, they could not applied to the loan and put in the side , until the next month sso they can have the full payment to subtract the loan .

Since that my loan will occured late charge and interest. I feel very upset and overhelm since I was cheating by Bank of America . I thought I will be help to get out of debt but now I have to pay more and may be a balloon payment.The supervisor at Customer service -Brad Proctor denied to waive or take off the interest and late charge. He advised us to start pay monthly as $3,357.93( the impound payment ) and reapply for loan modification. I followed his advise and paid $3,357.93 for Oct 2010 payment but today I received again a notice of Intent of Accelerate from Bank of America which was been asking to pay $11,662.70. The amount is $527.21 more than last time which I already paid $314.71 more then Septmeber payment.Please help as I do not know how to do . If your bank charged me like that then I never can pay  to end my outsanding amoutn  and I never will be help to have my loan modifify as President Obama home relief plan. Please look at Bank of America, they are  a large bank but try to rip off small people as us.
