Someone made a fraudulent checkcard with my number and someone else's name on the card. They went on a $4300.00 shopping spree the money came right out of my account. I filed a claim with bank of america they assured me that I would not be responsible for the charges. They credited my account bank for the $4300.00 4 Days later on a temporary basis. Pending a 45 day investigation.

I took the liberty of calling one of the stores that purchases were made at and the manager faxed me a copy of the sales draft. It was my credit card # and expiration date but it was not my name or signature. By the way the first charge occured at 4:30 P.m in New york city And at 4:25 P.m I was using my checkcard at a store in ft lauderdale, Florida.

Anyway 45 days later bank of america took the 4300.00 dollars back without notifying me. When I contacted them they said that the charges appeared to be mine so therefore they closed the investigation and said I could reopen it but I would have to wait another 45 days to get my money if they found that it was indeed fraud.

They refused to send me copies of the signed sales slips and now I've had to get my attorney involved which is costing me about $1500.00.

If you don't want this to happen to you do not open an account at bank of america and stay away from visa checkcards I know they're convenient but remember unlike a regular credit card that you just don't pay the bill a checkcard is tied to your checking account. If someone gets a hold of that # your out your money and I'm sure alot of you are like me I don't have an extra 4300.00 dollars sitting around this money was to pay most of my bills including my mortgage.

Hi Reinaldo; Your situation is similar to mine except the criminals didn't use your name and bank card no together as in mine. You should check my above posts I started on 8-7-04 here. I am appealing similar bogus and wrond fraud investigation decisions by BOA here in AZ right now. I really want to avoid the lawsuit stuff. If the govt. agencies can't shake some sense of the right thing into them, I'm going full-bore TV media here first to make a public spectacle of the BOA. I hope you still check here. Would you post a rebuttal comment on my above thread to update me how your situation turned out? Was the lawsuit pursued? Thanks,
