After my Chapter 13 hearing on May 29, 2004, I was given a payment plan which I did not examine until I got home.

I noticed that in addition to the arrearage and attorney fees I was charged, there was an unaccounted for charge of $8,284.92. In June of 2004, I immediately inquired of BankAtlantic for clarification of these charges.

After three incorrect amended arrearages by BankAtlantic via their three sets of attorneys. I finally prepared what I believed the correct charges should be. Based on inaccurate information given to me by BankAtlantic's representatives this was a tedious and time consuming process.

I forwarded my calculations to BankAtlantic last attorne. BankAtlantic agreed to accept my figures. I informed the attorney that I did not feel that I should be charged $3500 for the negligent accounting, and emotional stress that I had to endure because they could not come up with the correct figures.

BankAtlantic responded with and additional charge of $8,114.48 if I do not drop my objection to their claim. I am scheduled to go to court July 7, 2005.

I am interest in any lawsuits against financial instutitions that have broken statutes in regards to overcharging of taxes, interest and insurance.

Any documentation that I can use in Court would be beneficial. If there is an attorney who could assist me or give coaching as to steps that I should in my presentation to the Judge.
