Banyan Bay Marina Billing Fraud and theft of Boat Dania Beach Florida
On September 5, 2008, I took our boat to get work done it. Our mechanic, an independent contractor, has a relationship with Banyan Bay Marina in Fort Lauderdale, Florida. He told us to take the boat there, and he would work on it there.
I arrived there with the boat, and they hauled the boat with the Travelift (a lift for boats larger then ours) instead of the forklift because their forklift was broken (it looks very old and poorly maintained). They started to pressure wash the boat, which was something I did not want because it would take off the bottom paint, which it did.
I then went in to register in the office. They told me that it was now storm rates (it was Hurricane season, even though it is illegal in Florida to charge extra for Hurricanes), and because of this they had to charge me for a month of storage, $250, plus a travelift charge to haul & launch the boat of $240. I complained to them that I had to pay the higher rate (33% higher) because their forklift was broken. They did not seem to care. Knowing I have bigger battles to fight, I just paid this and moved on.
Later the following week they called me because I had mentioned I needed a new Bimini top. They gave me a price of $900, when the market rate is $350 (on the internet). I declined, and the guy asked me when I was going to move the boat out. I told him I had prepaid for a month, so I did not see the rush. He proceeded to tell me, Thanks for bringing us the garbage (my boat) axxhole.
A few days later that week, I met the mechanic on site to fix the motors. I asked the yard to put the boat in the water. They said I had to pay another $300 in charges to which they had no legitimate explanation for.
They now refuse to give me my boat back, and we have had to get a lawyer who has had to file a lawsuit to get the boat back. The lawsuit is pending, but I am seeking full damages.

Banyan Bay Marine Center has been in business for over 6 years. Our staff has over 30 years of boating experience. Banyan Bay Marina delivers quality backed with experience in all our services. Born and living in Ft Lauderdale we take pride in servicing boats in south florida. It is hard to please all customers but we make it the upmost importance to treat people fairly and honest. Giving the best advise to ensure the best boating experience possible. Boat yards are the least favorite place for most boat owners and often turn them off of boating. Banyan Bay Marina tries to walk each customer thru the boat yard process, keeping them informed of costs and services needed to ensure the best boating experience. This is not always cheap or standard, boats are very costly to maintain, as is operating a Marina. Ultamately if you are not enjoying the use of your boat it doesn't make financial sense to have one. Happiness from use of your boat is the only way to justify the expenses of owning. Maintenance is the key to keeping a boat in good condition.

In reference the the complaint, which was in 2008. Did not realize this report was out there. The customer sewed Banyan Bay and lost. The boat came into marina while the storm was appoaching, customer was in panic because storm was coming. Customer was informed of the hurricane storage rates. The storm turn away last minute and the customer felt since the storm did not hit that he should not be charged hurricane rate. Customer was given preferred treatment in taking his boat out of the water and harms way and given a discounted rate because the customer agreed to do service work with Banyan Bay. At the end of the day he never owned up to his end of the agreement. Banyan bay still charged him a reduced rate. Customer then picked apart every billing item and complained about it. I feel this was his plan from the start. We have learn a valuable lesson in all this and have moved on.

Our hurricane storage is the safest in the county. Banyan Bay offers a hurricane plan to boat owners. $500.00 per hurricane season. Non refundable, payment before season starts. The hurricane service includes storage place in marina yard in the event of storms and preping the boat for storms as per customer needs (removing izings glass, cushions, etc.). Boat must be brought into marina as soon as hurricane WARNING is issued and when a hurricane WATCH is issued the marina closes. Normal Haul out and block fees are additional. Without hurricane plan, Cost is $500.00 each storm (up to 20 days storage) plus $15 per ft haul out and $100 block fees. Plan ahead!
Our Travel lift is $8 per ft for haul out of boats over 30ft or any boats with weight forward. The Forklift haul out is $6 per ft boats under 30ft. Our lift operators make the call on which machine to use, with safety as the deciding factor. Banyan Bay offers all marine services, including marine coverings. Our base price for a custom made bimini top, using top of the line products (ss parts/ stamoid/etc.) is $800.00 and goes up, depending on size and equipment on top of bimini. We do sell pre made bimini tops starting at $350.00, but do not recomend them because they are cheaply made and often only last 1 year. Banyan bay requires that all boat be pressure washed, due to stink from growth. Also we charge a daily workrack fee of $30 per day for boats bringing in outside subcontractors (insurance required).
