Beneficial - HFC Collected payment arrangements then filed judgement against me causing me 3,000 in additional fees. Memphis Tennessee
I took out a loan of 6,000 for my daughter but it was in my name, she was responsible for paying it. My daughter had been paying on the loan for a year and she got behind 4 months in payment. After I learned she was behind, I mailed in two payments.
About a month later I received a judgement and I called and talked to one of the representatives who told me if I made ianother payment I would not have to go to court. I made a payment to that representative via phone. The court date was not cancelled by the company, therefore I missed a court date. I was then sent a letter from their attorney stating I owed them 9,972.00. I went to Financial Counselors of America to see if they could help since at the time I was unemployed and was confused as to how I could owe an additional 3,000 and none of our payments seemed to count toward the balance. They advised me to go to the courts, set a court date and take my financial records which I did. The judge did not want to see my financial records and I was told a motion had already been set and I was ordered to pay the courts 9,972 at $150 per month. I will be forever paying this debt, and I was not given the opportunity to caught up on what was only a few notes behind. Now I have a judgement on my credit report and a hefty bill as well. The only other advise I was given was to file bankruptcy, which I do not want to do. This company is a liar, insensitive to their customers and will not take the opportunity to work with you. The bill was only a few months behind, now I am paying over 3,000 in attorney fees and penalities. Can anyone help or advise?
