I was enrolled in a program that automatically billed my credit card for the drug Suvaril. First of all I only asked for the free sample I did not enroll in a program. When I called Berkeley said I had to cancel per the website-which I did and printed out the confirmation letter and number. That was on Aug. 4th.

On Aug. 16th my credit card was again charged 79.99 for the Suvaril which I never ordered or received. I called Berkeley and was given a no# 866-816-0099 to call Eight Squared which is no longer in service!!! I have called Berkeley numerous times and wait on hold for as long as 40 min. to be given the run around.

I will cancel my card but people please do not order anything from Berkeley Nutraceuticals I really hold the responsible because they do not care that they are being used by this Eight Squared company to rip people off!!!!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

I looked on the website today where I ordered the so called 30 day free trial of "Suvaril"and guess what I found? They have changed their refund policy with no mention of a "automatic enrollment into a Managed care Plan" and you get a 7 day free sample of Suvaril. It also says "Money back Garantee" if you are not completely satisfied with the product. These are all new they were not posted when I was trying to get help on Aug. 16th with money that had been taken from my cc account. In small print this states "In effect for all orders after August 16 2004.I do believe between all my complaints to Attorney generals office. BBB of Raleigh NC and Cincinnati OH the help from my own bank and especially RipOffReport.Com and I"m sure all the pages of past consumer complaints that are posted here (which I directed all these offices to look up)helped to bring about these policy changes. Please go to the site and take a look. www.Suvaril.com This is also the site that a supervisor from Eight Squared said I could not have ordered from but thats funny because thats exactly the same site I printed off my cancellation confirmation letter. (By the way Eight Squared was the name used to bill my CC for charges I did not authorize!) I'm sure anyone who is reading this by now realizes there are more alias names, addresses and phone numbers for this Berkeley Nutraceutical company so buyer continue to beware!!!!!

Please!!!The only way to keep these parasites from sucking your account dry is to go to your bank and tell them what is happening.Take copies of some of these reports and any other articles such as credit card bills or bank accounts where this company has deducted money. My bank replaced what they took and we closed our account.That is the only way to get it stopped.Please call,e-mail or write the Attorney Generals office (address can be found on the web) of what ever state you have been ripped off from such as Ohio and North Carolina and the Better Business Bureau of each and every city you can find. These two companies move around very fast and change their addresses and I do not beleive there is a valid phone number any where for either of them. The Ohio Attorney Generals office replied to me and I feel they are truly going to help me.Also my bank has sent their attorney after them to recover the money they had to replace for me. I am a nurse and I have never come accross such misleading and criminal like advertising in all my life. Please do one of the above report them to someone and get to your banking institution as fast as you can!!!!

08/19/04 ADDENDUM- Following my initial rip off report I contacted the Better Business Bureau of North Carolina to which there were no complaints listed according to the BBB website but they said I could search the National database and low and behold there they were with at that time 51 complaints filed and mostly for their fraudulent billing of products that people had cancelled or did not order!Please if you have been ripped off by either of these companies Eight squared or Berkeley Nutraceuticals please file a complaint with the BBB of North Carolina there are two listed the one you want is BBB serving Eastern North Carolina just maybe if enough people complain we can stop this fradulent activity!!!
