Our company signed a contract with Blue Power Distributed Energy Corporation in February of 2011.  The first FIT application was submitted with the fee by Blue Power.  All submissions have been on hold from the Ontario Power Authority (OPA).

It is now January 2013 and the OPA has reopened acceptance for FIT applications.  But wait..... when we contacted Blue Power to finalize resubmission details of our FIT application we are given another company to contact with regards to this application.

We received no written or verbal communication of any kind from Blue Power- John Nassar that one our representative that we had dealt with was no longer with the company but that our information regarding our FIT application had been passed on to another company.

Of course, the deposit which was paid to cover expenses with the contract submission to the OPA were not passed on.  So Blue Power - John Nassar is holding and refusing to release $4,500 of our deposit to complete our resubmission.

When asked to provide a detailed receipt of our account on the use of our deposit funds he has been unable to do so.  This request was made before 10:30 am on Friday January 18th, 2013.  Apparently Blue Power is unable to provide me with this receipt within an hour.  When asked how soon I could expect to receive one via email; the response was possibly Monday.  Three days after the request. 

Not good enough I say, as they should have a control report in our file documenting time spent on our file and submission fees paid on our behalf from our $5000 deposit.  Not a professional way to do business. 

Considering we have been monitoring and updating our own file registered with the OPA since it was first submitted and have been following up with the OPA to check the status of our application.  

SO I ASK YOU ..... JOHN NASSAR what has your company done to earn this money and keep our deposit when the initial file submission was only a $500 fee to the OPA?????

Needless to say he has not heard the last from me on this matter.

Point in fact we never sent or received anything in writing asking us to give permission for our contract to be transferred we found this out after persistant calling on our behalf.  Never contacted by Blue Power to advise that they were no longer authorized under the OPA to proceed with our contract no warm hand off to replacement company.

Also when contract was signed with Blue Power we advised agent that building wasn't up and that we were planning on building one but wanted to secure solar contract and funding prior to building.  Agent said it shouldn't be a problem but send in application to start process.

Lawsuit did proceed and restitution was paid by Blue Power after a 2 year legal battle.  Their lawyers used several delay tactics to see if we would walk away, but they finally settled out of court.

This complaint is from Mr. Brian Johnstone, aka. 717210 Ltd., 996 Highway 124.  Mr. Johnstone contracted with Blue Power to secure a Feed In Tarrif contract with the Ontairo Power Authority.  The FIT refers number is FIT-FA12RWJ.

Mr. Johnstone provided a deposit to do this work of which $500 went towards an application fee to the Ontario Power Authority, $2,000 as a security deposit to the OPA as well.  Mr. Johnstone represented to Blue Power that he was contstructing a building on the site at the time.  Subsequently this did not happen in time and his application was denied. 

Mr. Johnstone wanted a full refund including the expenses we incurred and paid to the OPA.  in an effort to blackmail Blue Power he posted this complaint.  As a business owner he knows very well that companies need to cover their costs and professional services are not free!  If he felt his case was strong then he could have sought legal remedy from the courts. He did not. 

After further negotiations with Mr. Johnstone he agreed to have his file transfered to another company that would initiate his re-appliaction.  He agreed to pay a futher sum to that company for the work.  Blue Power refunded the moneis remaining from the initial deposit as agreed to by the parties. 

If Mr. Johnstone was an outstanding person he would have provided this update to those seeking the truth. 

 

Just wanted to let you know that Mr. Johnstone sent us the money so we will proceed to submit his hard copy application.
