We purchased this vehicle in January 2005. The computerize control system in this vehicle started to fail in October 2005. It has been in for service 7 times for control system failures dealing with the transmission, and now the brakes.

This vehicle when accelerating automatically downshifts. The transmission will disengage for 10+ seconds which it slows down. In traffic this is potentially lethal. They claim that this is normal. Most recently the vehicle on the way home from service failed to brake. When I took my foot off the accelerator and hit the brake pedal (twice) it accelerated instead! We had the X3 towed in and now they find no fault code with the computer and find no issues. In fact the quote from the e-mail was "From my observation from roadtesting and I can see where it is very easy for this to happen is that when sitting at rest with the brake applied there may be a possibility that the drivers foot on the accelerator may rest upon the brake pedal as well which in turn would cause this reaction." (Brian Blakeslee, VOB Service Manager) The only problem with this is that the vehicle was not at rest, but driving at 35 miles per hour down hill to a red traffic light!

We have no choice but to go into legal action against them. If you have had similar experiences, please contact us for possible class action.

Hello, I purchased a used 7 series BMW in February 2006 under a CPO warranty. I have had to put it in the shop at least 10-15 times within the past 2 years. I have experienced reoccurring problems as well as something malufunctioning monthly. If you are, in fact, taking out a class action suit against BMW, I would greatly appreciate it if you could contact me at my "non-personal email": [email protected] to discuss any remedies that will help in my fight against this company. I am going to hire legal representation one way or the other because both Crown BMW in Richmond, VA and BMW of North America have failed to render any probable/satisfying solutions. Also, as an owner of a BMW, I can surely testify to the problems experienced with these cars. They do not live up to the ultimate driving machines...more like the ultimate nightmare. So if I can help you in any way possible, I would be more than glad to. Hopefully, we can help eachother: and I know we are not alone. I greatly appreciate your help.

The scrooge update from VOB & BMW

On December 19, 2008 the vehicle was towed back into VOB by BMW because of the brake failure. On December 22, 2008 Brian Blakesley telephoned from VOB stating that they could not reproduce the fault, no fault codes were indicated, and nothing was wrong with the brakes. I again contacted BMW and on December 19, 2008 was called from BMW North America. They informed me that they would work this out. The "work out came at 3:25 pm on Tuesday, December 23, 2008 from VOB stating that I needed to pick up my car or they would charge storage costs! I again contacted BMW North America and was told that the case was now reopened (I never knew that it was closed) but VOB was a private dealer, and that they could return the vehicle. They have required that I sign that the vehicle was "repaired". I cannot and won't sign that it has been repaired when they claimed nothing was wrong. This is the legal "Catch 22" that they use. Beware, trust nothing unless in writing from this dealer. This is yet to be resolved. Can we say Merry Christmas from VOB?
