I received a very official looking letter claiming I had "outstanding debt to Schumacher Med Corp Of Al in the amount of $881.00 relating to medical and/or ambulance services provided."

Further in the letter were threatening sentences regarding advising "certain credit bureaus" and that this "may affect your ability to obtain credit."

I knew there could be no such debt because I monitor my credit report regularly. Before even responding to their letter, I googled the name of their law firm and found your web site. Thank goodness!

After learning from you about their bogus operations, I am preparing myself to file a report with the California AG, my own Arizona AG, the FTC, the US Postal Services, and my county proscecutor. I'd love to see this guy put behind bars!

Make them pay you for your time and expenses. File the lawsuit immediately on Boyajain, and the next one who contacts you. This puts an end to the cycle. Guaranteed.

If the name on the letter is not yours, they probably don't have your info, especially your SS#. One of my co-workers has been receiving debt-collector calls and letters for months asking for a Joe Schmoe, and she's told them repeatedly that they have the wrong person. Now she's got her son (a partner at a major law firm) sending them cease communications letters, and they STILL keep contacting her. A lawsuit is imminent. Boyajian and NCO have a cozy business relationship. NCO is even slimier than Jack the Rat, and Bud Hibbs has plenty of dirt on them. From my professional dealings with NCO, I've come to believe that the NC stands for "not competent", since I had a cancelled check for the debt they were trying to collect, and they STILL accused me of trying to cheat them. A pathetic bunch of ex-cons and short-bus rejects if you ask me.

Help! Boyajian has sold my bogus debt to another collector!

I am the original author of this report. Thanks to the help on this website as well as Budd Hibbs, I wrote to Boyajian Law Offices, declaring the debt to be bogus and demanding proof. I also demanded that they cease and desist from contacting me. I made a mistake, though, and did not tell them that the person named on the debt has a different name from me. As a result, Boyajian has sold my "debt" to another collector--NCO Financial Systems out of Wilmington, DE, which I understand is just as sleezy as Boyajian. NCO responded back to me with "proof" of the debt in another person's name. Even tho I can write back claiming that is not my name, never has been, and I do not know this person, how can I get out of this cycle of being "sold off" to other collectors?

Steve is correct on all counts. Boyajian is notorious for trying to collect debts that are either 100% fabricated or time-barred by statute. My "debt" with him falls into both categories. When I received a letter last November claiming I owed $250 from a hospital visit in 1998, I immediately called and disputed the debt. Little did I know his operators are both rude and stupid, and I got nowhere on the phone. I sent a letter demanding proof of debt, ownership of debt and license to collect in IL and haven't heard from him since. In the meantime, I filed complaints with the FTC and IL Attorney General. Know your rights as a consumer. If you never incurred the debt or it's past the SOL, Boyajian doesn't have a leg to stand on legally (then again, most snakes don't). The burden of proof is on him, and the truth isn't his strong suit. He's got the attorneys general of CT and NY breathing down his neck for exactly the same stunt he's pulled on you. Don't let him get away with it.

Liz, This "law firm" debt collection outfit is a JOKE at best. Jackie is a real moron, but you do need to respond. Here is what you do. Stay off the phone. Never speak to any debt collector. And when you write, NEVER sign your letter, just print, and never give any personal info like SS#, DOB, etc. Always use certified mail, return reciept requested. Put the certified# on the letter itself, and keep a copy for your records. In this letter CLEARLY dispute the debt, And, DEMAND to see copies of any documentation to support the debt including something you signed. Also demand a full account history of said debt for purposes of determining SOL. Now, you demand proof that he is legally licensed to collect in AZ where you live AND that he has the legal right to collect such debt. If he claims to own it, you are entitled to see the entire chain of title, as well as the purchase contract, proof of payment and amout paid. Do all of this and you will never here from him again. He only goes after the default. If you fight back, he goes away. Jack Boyajain is a JUNK DEBT BUYER and buys these very old, legally uncollectable debts for a penny or less on the dollar and just hopes he can intimidate someone into unknowingly reaffirming it by making a payment or agreement to pay. Then he can legally sue you for it. FYI.The SOL in AZ on medical bills is 5 years, so even if you did at one time owe this amount, it is most likely not legally collectable anyway.

Should I respond to my bogus Boyajian letter?

I am the author of this report. Can someone advise me if I need to legally respond to the bogus collection letter I received from Boyajian on Sept. 14? I would prefer not to since he only has my previous address before my move on June 1. I don't believe he has my new phone number either. However, I am wondering if I should respond to his letter to make my case legally stronger (if necessary). I could get a PO Box as return address. Thanks, Liz in Scottsdale
