Brian L Mallia Going to be sued for extortion, libel, defamation, tortious interference with business expectancy Southgate, Michigan
Brian L Mallia gave me a check June 2006 for photography at wedding to be held on September 8 2007 at 3 locations up to 9 hours. In early September 2007 I was asked to photograph another wedding on short notice so I sent another person I had worked with previously with many years experience and enough equipment to get the job done in the best way possible. This guy and his angry wife called me cursing on the phone and demanded a full refund even though the photographer was there all day working but they did not like his style of photography. A few minutes later I spoke to the photographer and he reported verbal abuse and threats of violence by key members of the bridal party. I told him he could depart without delay but he agreed to stay unless the situation got worse or they continued making threats. My company had a right to send any photographer to render services listed on the contract. This contract was never canceled and we gave them a 50% discount up front. We had a legal and contractual right to keep the money for services rendered. They harassed my company for the next several weeks on the internet with misleading information, defamatory remarks, embellished statements, and bogus claims to frieghten others away from my company and warned me numerous times it would not stop unless I gave them all their money back and all the wedding photos.
To this day they claim the photographer kept 75% of the photos. He gave me every image on a double-layer DVD which I then delivered to the clients Brian and Melissa (Galea) Mallia. He shot every photo in RAW format and we gave them rights to make prints forever. Over 2 years later they post a report on the internet attacking me and the company which was forced to close last year becuase the malicious reviews and reports caused extensive damage to my reputation and that of the business. They never went to court to file a small claims or civil suit but attacked me on various websites. Its to the point now I must take serious legal actions against these people to stop the ongoing harassment and threats. They need to understand those actions have serious consequences and I've talked with a lawyer that specializes in civil cases regarding libel, defamation, tortious interferece with business expectancy. We also hired several agents to collect evidence of defmatory postings on the internet. Those persons will be sued for those actions if we find it and link it to the company. Brian and Melissa Mallia cannot be trusted - they cost my business several thousand in damages and legal fees. What they did was unforgivable. Do not work for these people - they could ruin your personal or business reputation with a cable modem and few key strokes. Erase many years of hard work and force you to pay substantial legal fees if they get pissed at you for any reason. Its not worth the risk - don't provide any type of professional service to these people - they don't accept any blame, ignore contracts and make threats if you don't refund their money when the job is finished.
