In brief, this is a police, tenant and guest matter. The following is my full story. The guest whom I was trying to help turned on me then the police turned on me, which resulted on me (tenant) going to jail. When I returned home, my home as trashed. The guest was last seen in Santa Monica California with the same clothes she was wearing the day of the incident/probably, homeless still.

The following text is a full report that was given to the defense attorney on October the 19th-2005 at 8,45 a.m. Court date for Trial/Pre-trial is set for October 24th-2005 at 1,30p.m.

How I met the Parks and Hanney.

I met Ms. Mystia (aka, Kim/Kimberly/Mystress Crystal/Mistress Kimberly Silk) Parks about five years ago briefly through a friend who is a musician and Ms. Parks was looking for a guitar player. This friend had told Ms. Parks that I was a very good musician and wished to meet me. Parks and I spoke briefly and she asked me to play lead guitar on her songs, but declined. I did not speak to her again until 2005. Ms. Parks called me a few times during the first few months of 2005, but our conversations were very brief and I was suspicious of her. I had never met Mr. Hanney until one day during an encounter at a music rehearsal room I was at in Downtown Los Angeles where they ran into me and asked me for help and money. This was also approximately during the early months of 2005. They told me they where living in Mr. Hanneys white Jeep and looking for a place to live. They also asked me If I knew of anyone who sold methamphetamine. I refused to help them with any drug matters, but did give them $10.00 for gasoline and did not see them again until August 20th, 2005.

On August the 20th, 2005, during the day, Mystia Parks and Thomas James Hanney abruptly came knocking at my door pleading for me to help them financially and provide them a place to live until Ms. Parks received her SSI money (I will bring proof of this on my court date). I told them I could not help them. I did ask Ms. Parks to tell me how they got into this situation. Mr. Hanney became upset when I refused to help them and Ms. Parks yelled at him to leave so she could have a talk with me privately. Mr. Hanney left my home and Ms. Parks and I sat and talked.

Parks and Hanney's Drug and Living Cituation.

Ms. Parks indicated that she had been evicted from her apartment due to a dispute with a guest of hers in which she had brandished and pointed a gun on them, resulting in her commitment to a mental hospital (I will bring this evidence on my court date. The paper verifies the weapon and mental institution release agreement that was given to her). Ms. Parks indicated that she had been on heavy anti-depressants and abusing a sedative called Klanozopin (I will bring this evidence on my court date. The bottle has her name and was left at my home). After her eviction and release from the mental hospital, Ms. Parks moved in with Mr. Hanney. Ms. Parks confessed that she had been smoking crack and methamphetamine with Mr. Hanney constantly and that Mr. Hanney had been smoking crack daily also. After she moved into Mr. Hanneys apartment, they both where evicted from Mr. Hanneys apartment for using drugs and not paying the rent. They both started to live in Mr. Hanneys white Jeep for many months.

Ms. Parks further told me that Mr. Hanney had used up all her savings and that she was tired of her lifestyle and wanted help. Ms. Parks told me she was tired of Mr. Hanney and wanted to leave him but did not know how. She wept and begged me to help her. Mr. Hanney had walked up to my front door and noticed her crying. Mr. Hanney walked inside and they both started to yell and argue. Mr. Hanney accused Ms. Parks and I of having an affair using very abusive language and then left. I told her that I could not let her stay in my home due to the strict rules of my lease and I could get in trouble for having a second person in my home. I then asked her if she had any money, she said she had none because they had been using drugs for days and days. I asked Ms. Parks if she was under the influence and she said she was but wanted to sober up desperately. She told me they had not slept for two days because they had been smoking methamphetamine. She told me that she was waiting for some huge dollar amount from the Social Security because all her SSI checks had been on hold because she did not have a stable address. She had been trying to borrowing money from her mother but confessed that her mother and sister did not want anything to do with her.

I began to feel sorry for Ms. Parks and knew of the difficulties to stop using drugs. I have been clean and sober for two years and felt that she was being sincere. I began to tell Ms. Parks that she could stay here but under and only under the following conditions (this was a verbal agreement only):

.

1-She could not stay any longer than the end of August 2005.

2-If she was caught using drugs in my home; she was to leave immediately without any questions.

3-If she received her SSI money before the end of August 2005, she was to leave immediately and offer to pay me for the days she stayed here, approximately ten days.

4-She was to not have any contact with Mr. Hanney or bring him into my home during her limited time here.

Ms. Parks agreed and agreed to leave before the end of August the 31st or sooner, if she received her SSI money. Ms. Parks then remained at my home for the next three days and Mr. Hanney left. Ms. Parks slept for extremely long hours due to being under the influence of methamphetamine. On the second day of her stay, I came home from the market and found her in my bedroom naked with a Latino male smoking methamphetamine. Both had been having sex, my bedroom was filled with the smell of methamphetamine.

Parks First Violation.

I told them to leave my home and go get a hotel room. The Latino male left and Ms. Parks stayed in the bedroom crying asking for forgiveness. She wept and I asked her about our agreement. She began to get on her knees and began to apologize intensely. I told her that I would not tolerate this a second time and she was to leave immediately if I caught her again. She agreed. The second night, she spent a lot of time talking and she continued to confess about her troubled lifestyle with Mr. Hanney and how guilty she felt about how her life ended up this way.

During her stay, I accompanied her to the Social Security office several times, but she was never able to obtain a check and told me that it was being held and bounced from one office to the other and was not due until the end of the month of August 2005.

Parks Second Violation.

On August 22nd, I went to the market, leaving Ms. Parks alone in my home. When I returned, I found her in the bathroom with a glass methamphetamine pipe in her hand. I told Ms. Parks to leave immediately and she began to beg me to forgive her and give her just one more chance. She kept telling me that she was going through withdrawals and it would take a short time before she could quit. I told her to throw that pipe into the toilet and tried to grab the paraphernalia from her hand but she did not want to throw it away. She began to struggle and burned me on the forehead (I have a photo as proof and will bring with me on my court date). When Ms. Parks saw this, she began to cry and apologize. I told her that she had to leave immediately and offered her a ride to any place she wanted. When she heard this, she began to ask me about my sobriety and how I held strong to avoid using. Our conversation went on for about an hour and I began to get very tired. She sat quietly and asked me if she could call a few people to find a place to stay. I agreed and, being very tired and feeling very stressed physically and emotionally, I fell asleep. When I woke up, she told me that she had to get some clothes from Mr. Hanney's vehichle and if I could let her come back so I could take her to wherever she was going to go. When she left, she was wearing a skirt, a Levi jacket, a blouse and a watch, all of which belonged to me. She left behind the pair of shorts, the top and the tennis shoes she was wearing when she arrived.

Ms. Parks did not return that evening and I locked my doors thinking she had left for good. The next day, August 23rd, 2005, she telephoned me at about 6:30 a.m. She immediately asked if I knew where she could score some methamphetamine. I was shocked and disappointed when I heard this and told her that I did not know where to get this. I asked her to return back to my home and return my clothes. I could hear Mr. Hanney in the background making sarcastic remarks. I told Ms. Parks that she was to now leave permanently and please return my belongings. Ms. Parks and Mr. Hanney arrived at my home at approximately at 3:00 pm.

When they knocked at my door, I saw Mr. Hanney and Ms. Parks through my window. I walked out on the balcony and told Mr. Hanney that he was not welcome in my home and to please wait outside while Ms. Parks returned my clothes and I returned hers. Mr. Hanney got belligerent and refused. He stated that he was coming inside with Ms. Parks whether I liked it or not. I asked him again to please wait outside and Ms. Parks was to leave in a minute as soon as she returned my property and I returned hers. He continued to refuse. I then told them that neither one was coming inside and both had to leave or I was going to call the police. They both seemed to be under the influence of methamphetamine as they appeared nervous and jumpy. As soon as they both heard me tell them I was going to call the police, they both immediately walked away.

Burbank Police Arrive at My Home.

When I saw them leave, I stood at my balcony trying to unwind from this stressful event and felt some relief, believing they where now permanently gone from my life. About fifteen minutes later, they returned with one police officer. When they arrived at my door, the officer asked me if I knew these two people, and I confirmed I did. The officer told me that Ms. Parks had paid me $250.00 for rent. I was shocked at this accusation and indicated that Ms. Parks was lying and using any money she had to purchase methamphetamine, which is why I asked her to leave. Ms. Parks began to argue that her mother had sent a check for $250.00 dollars. The officer then indicated that he was not interested in listening to our dispute and was leaving. I asked the officer to please remove these people from my home. I tried to show him my rental contract but he refused to look at it. I began to explain to him the agreement she had with me, but the officer refused to listen and told me to go get an eviction notice. I then asked him about Mr. Hanney and the officer said that since Ms. Parks allegedly gave me rent money, she had a right to have a guest. His attitude was very disrespectful. I then walked down the stairs and asked the second officer for his help hoping that he would be more understanding. The second officer also refused help to the point of even refusing to identify himself by name or badge number. I then walked up the stairs and got my digital camera and took a photograph of him. He, too, was very disrespectful. At this point, the other officer came down the stairs and said that Parks and Hanney agreed to leave and she was just going to get her clothes. I returned upstairs to my home with the first officer while the second one stayed downstairs the whole time. Ms. Parks walked into my bedroom, she locked the door and we waited for her. When some time had passed, the police officer told her she was taking to long. I had told the officer that she only came with a pair of shorts and a t-shirt. Ms. Parks walked out of my bedroom with a very large pillowcase filled with items. I asked the officer that I wanted to see what was in the bag and told him again that Ms. Parks had only came with a t-shirt and a pair of jeans. The officer agreed and told her to let me see the items in the pillowcase. I took the pillowcase and examined the contents. In the pillowcase were a large number of undergarments, high heel shoes, skirts and blouses, all of which were mine. I confronted Ms. Parks. Ms. Parks began to scream at me saying that the items were hers. The officer indicated that he would not deal with this dispute and was leaving. I pleaded with him to get these drug users out of my home and to help me. I told the officer that they where under the influence of methamphetamine but the officer never searched them or asked them about the methamphetamine. Instead, The officer then turned around and pointed his finger in my face and yelled that he had told me to get an eviction notice and that I was being stubborn and should not worry about a few items of clothing. He then walked away.

A sergeant arrived and discussed the issue with the two officers. The sergeant also refused to help me. None of the officers asked for any proof of Ms. Parks' or Mr. Hanney's identifcation. None of the officers checked for drugs or paraphernalia on them after I told them repeatedly that they where under the influence. I tried to explain and reason with the officers regarding my agreement with Ms. Parks, but none would respond and left.

My 911 help Calls and Arresting Threats.

The police left and, after some period of time, Mr. Hanney and Ms. Parks still had not left so I called the police again. When the police returned, they spoke with Mr. Hanney and Ms. Parks indicated that they agreed to leave but were going to take a shower first. The officer told me to sit for a few minutes so they could shower and leave. I sat in my living room for two hours and fifty minutes and both Mr. Hanney and Ms. Parks where still in my bedroom, locked inside. I did not hear the shower running or anything else. After waiting for so long, I had to use the bathroom. When I knocked at the door, I told Mr. Hanney and Ms. Parks that I urgently needed to use the bathroom. Mr. Hanney and Ms. Parks refused to let me in despite my plea to use the bathroom. Finally, Mr. Hanney did open the door, and I noticed that he had wedged the door with a large mirror they had taken off the wall. Ms. Parks walked out of the bathroom with the same clothes and was hiding something on the side of her waist. I could smell the methamphetamine smoke. I then said I had to use the bathroom. Mr. Hanney told me to hurry. I said nothing and walked into the bathroom. Inside, I could smell the smoke of the methamphetamine worse than in the bedroom. It was evident that that had not even taken any shower and where, instead, smoking methamphetamine the whole time. When I walked out of the bathroom, Ms. Parks was prancing around the room making circles as if she was a ballerina and grinning the whole time. I said to them that three hours had passed and they had agreed to take a shower and leave. Mr. Hanney looked at me with a fierce look and threated to hurt me. He also indicated that they weree going to ransack my house. When I heard this, I feared for my life and ran out the door with my house keys and cell phone. I called 911 many times and pleaded and cried to them for help. I kept telling them that I was being threatened and was going to get beaten up over and over again. I had also told the 911 operator that these people where drug users and under the influence. After the 911 operators continuously refused to send someone out to help me, the operator threatened to have me arrested for tying up the line. The 911 operator told me to stop calling because they where not going to help me.

I called a few friends but unfortunately no one was able to leave work and I was desperately terrified for my physical safety. I was horrified at the thought that Mr. Hanney and Ms. Parks where under the influence of methamphetamine and were threatening to harm me if I returned to my home. I was absolutely terrified and feared for my life. I was absolutely terrified and was not sure what else to do. If the police would not help me, my friends where not able to help me, who was I to ask for help? I had approximately $1,200.00 inside my apartment and feared that they would take it. This was for my rent, my bills, and food for the month and a few extra that I had saved. I also feared for my two cats and imagined that they would kill them. I kept thinking of the terrible consequences I could face if I did come back into the house. I wanted to call 911 but feared they would arrest me. I could not believe this was all happening and was absolutely shocked at the way the police had treated me.

Defending Myself.

After standing outside for a few minutes, I began to worry about how to defend myself so I could return to my home and reason with Mr. Hanney and Ms. Parks so I could get my money and cats and leave them alone. The only thing I could think of was a stick in my garage to use for self-defense. I retrieved the stick and as I walked up the stairs, the same two officers that had been here previously returned and asked what I was doing. I indicated that I was being physically threatened and needed to defend myself and asked them to please remove the people from my home. One officer yelled that he was not going to remove them, that they paid me rent and if I wanted them out I need to get an eviction notice. I stated that this was no longer a matter of getting them out, but that I was being threatened physically now, that they told me they where going to hurt me if I came back into the house again and that I needed to get some things and rescue my cats. I asked them to help me. They refused. I walked up the stairs holding the stick, looking ahead. I heard footsteps and saw the officer running towards me but on the first step, he tripped and hurt his hand. He became very angry. I dropped the stick and lifted my hands and apologized to them and said I didn't know what else to do and asked again for their support. I lost control of my emotions and I wept profusely. The officers did not answer me, but walked up the stairs and picked up the stick. He knocked on the door and told Ms. Parks and Mr. Hanney to come outside. The officer told me to come on back up stairs. When I stood there weeping, the officer asked Mr. Hanney and Ms. Parks if they had made physical threats against me. Mr. Hanney denied it. The officer then turned to me and indicated that I was mistaken. I responded that Mr. Hanney was obviously lying. The officer then asked them what was taking so long to shower and leave. I walked down the stairs and wanted to lie down because I was traumatized. I was weak and not able to stand. I laid down on the steps and saw that there was about fifteen to twenty police officers coming towards me. I was crying and trembling and in shock. When I sat on the ground with my head down weeping, I heard someone tell me to stand up and put my hands behind my back. I complied and was arrested. The officers took me to the back of the officer's car and I saw the two officers talk to Mr. Hanney and Ms. Parks. When all of the policemen started to walk away, I noticed that one of the officers made a command with his hand and arms, pointing to turn around and go back upstairs. Ms. Parks and Mr. Hanney walked up the stairs and into my home and the officers walked away while I was being taken into custody.

When I was in jail, I called my home several times to see if Mr. Hanney and Ms. Parks where in the house. Ms. Parks answered and I asked her why she did all this and lied to the police officer about giving me $250.00 dollars or rent. She responded by asking me how to turn on the cable TV. In the background I could hear Mr. Hanney mocking me. I had called my home three times for the next three days and they answered every time. My landlord indicated that she received many calls from the neighbors stating that they where hearing horrible screams and hearing that the walls where being torn apart. She told me that people where calling in to complain about things being smashed up against the walls and things being broken, very loud and disturbing. I was then threatened with an eviction.

Released From Jail After Being Encarcerated 6-days.

When I was released from jail, I was afraid to return to my home. I had a friend come over to escort to my apartment. My friend and I called for an officer to walk into my home with us. My friend and I had no idea who was in the house, how we where going to find it and or my property was still in the house. I feared that my two cats where killed. When an officer came, he was very understanding and listened as I related the facts. He immediately indicated that he would remove Mr. Hanney and Ms. Parks immediately from my home. I could not understand why the previous other officers refused to help me when this one was supportive. However, when he called in for backup, I overheard another officer tell him to stay away from us via the CB radio. A second officer arrived and both came with us to the apartment and witnessed the damages. However, they refused to give us a report and left saying this is a property issue and said there was nothing we could do. This is what I heard the officer said and the officers left.

After hearing this, I continued to fear and had to live in a hotel for five days because my apartment was uninhabitable. The floor was covered with broken glass. There was blood on the walls of the bathroom and kitchen. The carpet was burned and had to be replaced. The circuit breaker box was torn out of the wall and the walls had several large holes. The door to my bedroom was torn off and had a huge hole. My plants had been pulled out of their containers and thrown on the carpet. The television and stereo where scattered on the floor. There where countless cigarette butts on the floor and carpet. My bed was covered with all of my clothes and filled with massive amounts of breadcrumbs. There where maggots on the dining room area and underneath my clothes. My bedroom window was broken. The china cabinet and many of many dishes were broken. I also found numerous photos of Ms. Parks and other documents with Ms. Parks' name. The two people made over $100.00 worth of porn movies on the first night they where in my home.

I have had to replace 75% apartments property, including the walls, windows, locks, hinges, drywall, ceiling drywall, bathroom shower door, the electricity panels and other items. I spent close to $600.00 in a hotel because I was couldn't return to my home in the condition it was in. I had to pay several people to assist me in cleaning and disposing large amount of damaged items. I am very emotionally disturbed and have trouble sleeping because I fear for my life. I have my phone next to my bed with 911 pre-dialed in case I am attacked, but I fear that the Burbank Police department will not help me if such an incident should happen again. I search for the best surveillance cameras I can afford to install them around my home. I am seeing a therapist and fear to leave my home and returning to find it in destroyed. I am currently looking for a place to move but I have lost so much money that I cannot afford the first or last month rent for a new place.

I also believe that there was discrimination due to my gender. The same officer who handled the matter with Parks and Hanney, accompanied my friend back to my home so they could remove my vehichle from the street but kept identifying me as him. I appear to be a female and it is against the law to discriminate a transgendered person for their gender orientation. My friend felt violated and humiliated after the officer questioned him about my gender and involvement with a person like me, a male to female transgendered person.

I hereby declare that what I have told is true and correct to the best of my memory.

*Penal Code 417 (A)(1) states that, UNLESS someone uses such deadly weapon in SELF DEFENSE is not guilty.

*First, I never used such a weapon as it states in the Penal Code and was not intending to use it unless it was in self defense. Thomas James Hanney threatened to beat me up if I returned into my own house. The 911 operator refused to help me when I told them this and threatened to arrest me despite my cry for help. No one would help me and unfortunately, I had no choice but to find something to defend myself just in case Hanney truly did beat me up. The police report does not state any self-defense in their report.

*I know where Paks was evicted from. I visited the area where the police report states they lived, no one lives there. I called Parks mothers home and they dont have any communication with Parks.

This needs to be written in a book. If you knew the word NO, none of this would had happened. She left, then you let her back in. You knew you had a problem a few days after she left and came back. Then you should had gone to court and asked for a restraining order so they could never come back. Shoot, you want to sue the police? Bottom line its your falt !!! Sue your mom for not giving you the brains to say no. Not the police for not being your garbage collector. The mirror says it all. Think next time.

i was locked up in jail for a month for a less then misdemeanor crime. i lost 1 month of my life due to the fact that the judge went on vacation and when it was over the judge slapped me with $100.00 saying i had to pay. i found out 4 years later that i had a warrent out for my arrest for not paying the $100.00. so i went in front of the same judge and said i was in jail longer then i should have been cunsidering the fact that i did a month for a crime thats a ticket. so i cleared up my case and learned that cop are out there to clean up real crime like who stole the dounuts and lets get the black guy for anything and lets take the husband away for getting his a** kicked by his wife but never laid a finger on her anyway what it comes down to if you have tweekers in you house you shoot them dead that way you can claim self defence don't call the police till after you shoot them and as long as you tell the cops it was a house invasion then you should never do any time after your case is heard in court

that an attorney is asking for in order to represent me. I am going to have both calls as advised because I know I had called 911 for help and they refused to help me. When you say go after the cop who did not believe me, mean I can sue him for money? the city of Burbank? What about my time in jail I spent, can I get money back for that? what about my criminal record, is that going to be cleared once I win? Thanks Monica.

he mentioned to you to have your lawyer get every single recorded or documented proof that you have. Since you did make the original call to 911 and they refused to help. (It's been know to happen with deadly consiquences.) I can only assume that they made one after yours. Have your lawyer supoena both calls. If your call came first then it will definately prove that it is SELF-DEFENSE. And then go after the police officer who didn't believe you. Good luck. I'll be praying for you.

Dear Mr. Retired LAPD, when you said I had a right to confront the accusers, is that the two Burbank PD's that took me in or the two people that entered and accused me of bashing their heads? According to the police, they said that the two people who caused all this mess, told them that I told them, Id bash their heads. According to the BBPD, they figured since Parks and Hanney told the police I was going to bash their heads, then seeing me with a 2x4, Parks and Hanney where right! So, this is my question, if parks and Hanney accused me and told the BBPD of bashing their heads, dont they have to be there to accuse me of that? I know the BBPD will be there, but dont the actualy people who said, "she said she was going to bash our heads in" also have to be there? After all, because of Parks and Hanney's lie, I was arrested! If they had not said this, I would of never had any 2x4 to protect myself , self defense; They, Parks and Hanmey where the ones who told me, "we are going to kick your f**king a*s if you come back in here again, and wea are going to go through your whole f**king house." The photos and video tape I have of the damages to my house, corroberate my truth right?

I also am going to do a timeline, like you said, from the time the BBPD came and the time the 911 threatened to arrest me. On the police report, it says, "we saw the S. go out of the apartment slamming and screaming. Walked down the stairs and into her garage to grab a 2x4 then we took it out of her hands." Fact, I took the 2x4 AFTER the 911 calls refused to help me and I then walked into my garage to defend myself because the two people in my home said "we are going to kick your f**king a*s and go through your whole f**king house if you come back in here." Thats when I called 911 for help, they threatened to arrest me and thats when I found myself in a self defense mode. It was two against one if the people in my home did try to beat me up! When I was walking up the stairs, I hear the BBPD yell, "hey hey, where are you going with that.." I turned around, and saw both BBPD's, same ones as in the past, walking very casually with their hands on their belts.They where close to the sidewalk, about 30feet away from me. I then said, "Oh thank you your here to help me, please sir, these people are in my home getting high and they threatened to beat me up. Are you going to get them out of here now, please?" They began to yell at me and saying, "Why are you so d**n stubbor, we told you you have to go get an eviction and they have a right to be there." I then told them, "sir, they threatened to beat me up, I have to defend myself, the 911 operator threatened to arrest me. Im not doing nothing with this stick unless they try to beat me up. If you cant help me, 911 threatens to arrest me for alling them for help, my friends are at work and cannot come to help me, who is going to help me then?" Both BBPD's said nothing. Then I said one more time, "are you going to protect me and help me sir yes or no?" Again, they yelled, "NO, WE TOLD YOU NO BLAH BLAH BLAH......" and thats when I turned around and said, "Ok then I will get them out of here if you dont, I have to defend myself." And started to walk up the stairs. After this, I heard foot steps and turned around. The same officer who was yelling at me triped on the first step of the stairway. I then saw this and wasterrified so I threw the 2x4 away from the officer, up against the doorway of the apartment. I threw my hands up and yelled, "Ok, Ok, I give up, Im sorry,I'll leave them alone, I dont know what else to do, Im sorry, Im sorry." and began to cry out of control. The BBPD claims they saw me walkout the door, go into my garage, and grab a 2x4, then take it out of my hands. They lied othe police report! This is to the only lie on the police report they made either! I wrote a 17page detail by detail to everything and words that I remembered in order to correct the BBPDs report. My 17page report was given to the public defendor. So yes, I was told the same things you told me but this was Jacobee and Myers criminal attorneys. I am currently having a very difficult time trying to come up with another 700dollars for the flat fee of $3500.00 that they are asking to represent me! I have a few people helping me financially to come up with this money but I first need to hear from the public defender (who has showed me very little hope to defend me by the way) to see what she has come up with to help me. I am fighting this because It was a self defense issue. I am fighting this because I see that in these days, if you even go look for a job, your criminal record is used against you! I am fighting this because I have been wrongfully accused of. Also, the two people who caused all this have been seen in Santa Monica. Mystia Parks(Black/Negro)and Thomas James Hanney (white male). Both are heavy methamphetamine and crack users. They are living in a white Jeep Cherokee with a black paint line at the bottom of the jeeps side body. When I saw them, I did not confront them but they both where wearing the same clothese, two months later, they wore when they where here. Mystia Parks wears a jeans Levi shorts, a tshirt, a dark straight hair wig, white tennis shoes and take large amounts of Clonopin and Prozac. Thomas James Hanney wore a redish brown jacked with levi pants and has a short brushy beard. Short hair and almost redish/blond.Has a deep voice and both where evicted from their previous apartments due to not paying the rent. Parks has been in mental hospitals and was giving a paper that says she is not to own any handweapons ever. I found all this information in my apartment after I got out of jail and Mystia Parks also confessed this to me. When I got out of jail, I then realized she was telling me the truth! I really doubt that these two are going to be very stupid enough to go to court (if the BBPD can find them) and testify to what they told the police, that I was going to bash their heads! After what they destroyed all over my home, I seriously doubt they are going to showup in court and lie about this again. Thank you for your advise and anymore advice is greatfully appreciated.

Im retired from LAPD, so I won't get into what should have, would have or could have happened regarding the actions of the Burbank Police. However, as a crimonal defendant, you have the right to confront your accusors, ie the two indivduals, if they don't show up for trial, the case will be dismissed, PERIOD. I hope your Public Defender has subpeoned the 911 phone and radio records for the time in question.

Remember, he needs subpeona ALL the phone and RADIO records including the time BEFORE and AFTER the incident.

He also needs to subpeona the RADIO records for the SECONDARY/TACTICAL radio channel, so you can have a record of what the officer said about you and the incident during and after the incident. Also he needs to subpeona ALL the phone records, not only the 911 call. Burbank RECORDS ALL of their phone lines. You might get a surprise when you listen to the phone conversation between the officer isn the field and the Watch Commander in the station. This could help you a lot. The Public Defender needs to make a "PITCHESS MOTION" which will allow the court to look into the disclipinary records of the officers involved. A personnel complaint should be made IN WRITING against the officer involved AFTER the conclusion of this case. I am SERIOUS about getting these records. If nothing else, it will show the police department that you smell a rat and will not leave any stone unturned on you quest for the truth. DO NOT PLEAD GUILTY!

1st, thank you for the first rebuttal. I returned from court and was offered a lesser charge but refused it. The defense attorney told me if I wanted to take a Disturbing The Peace charge and go to anger management, so many amount of years for probation and pay a bunch of fines but refused it. Ive been in jail already six days, I lost close to $3000.00 dollars in damages, Im still seeing a mental therapist and now they want me to plea to lesser charge? If I did accept this, Id be admitting against myself and IM the one who is going to have a negative mark on my criminal record, which will be used against me if I ever run into any sort of problems in the future.

The defense attorney told me that there was a mandator jail time of 30days if I lost the trial. I told her if being i jail for six days was not enough, in case I lost? She said it was now going to go into a trial and I will have to face the officer/s who where at the scene. I now also have been told by the defense attorney to bring proof of the damages to my apartment, which I have about 60 photos and a 45minute video I took. I have to inconvenience my friend who was a witness when I came home and found my home vandalized. I have to bring my brother from San Diego as another witness because he was the one who drove to help me fix my apartment back to normal. I dont mind all of this but the threat of loosing and getting another amount of jail time burns my hatred for he law system because it will take money to win this! It is why Im in this site to hopefully find help wtih this or an attorney to assist me.

I am a limited income person but do have a 2003 Nissan Frontier Pick up in which I will be gladly able to use as collateral if an attorney is reading this and trusts me to pay him/her for their assitance in this matter. The vehichle is in excellent conditon and worth at least 10thousand dollars from a private buyer. If not, Id have to sell alot of my valuable electronic equipment to pay an attorneys starting fees.

I also just found out that the prosecutor has to keep a good record of winning cases so it can look good on thier record, even if the other person is innocent. What ever happened to a fair trail?

I certainly hope you are filing suit not only against the PD but also the city. This type of thing should never happen. I do have to say that your intial mistake was getting involved with this woman in the first place. However, we all, as human beings, do take pity on others. Sadly, there are those who manipulate and take advantage of that.

It sounds as if, this girl and her cohort will get what's coming to them in the end. The two officers who ignored your requests for help because of your um, forgive my ignorance but I don't know the proper word to use, "preference for self expression?" should be removed from the police department. Aren't police officers required to take sensitivity training or something?

This is just awful and I hope everything works out 100% to your advantage. Best of luck.
