Last October 2004 I started having problems with Capital One Auto Finance. After a year with them they started losing payments and harassing me. I refinanced the loan with Key Bank Auto. July of 2005 I receive a letter from Key Bank that they had sold my account back to Cap One Auto. I couldn't believe it!!!

My first payment with Cap One was 8/12. I wired the payment by Western Union Quick Collect. 8/16 I received a call from the collections department demanding a check by phone because the payment was now 4 days past due. I told the guy that the payment had been made by Quick collect. He put me on hold then came back and said it wasn't in their system. He would note what I had told him and put a hold on my account until the 19th. If the payment still was not in the system the calls would begin again and repo actions would be taken. I told the jerk that I had proof the payment was made and all the paper work from western Union proving the payment had been made and that there hadn't better be anymore calls or repo action!! He again put me on hold. He came back and asked for the mctn number. I gave it to him and he assured me there would be no more calls and my payment had been documented. Yeah right.

This was the reason I refinanced the vehicle to get away from there fraudulent practices. They can't keep track of anything and they won't cooperate when you try to work with them. They sit on payments then tack on late charges.

Somebody needs to file a class action suit against them to stop all this. Big companies like Cap One have been given way toooooooo much power against the consumer and something needs to be done soon!!!

Please, if you can help it at all don't get mixed up with these guys!!!

i fell behind due to cap 1 buying contract from oynx,i accidently sent the money order to their proof of insurence branch office in min rather then tx, was my bad, i was constantly harresed before it was even ten days late. in a period of two weeks i got caught up, via quick collect. on making the second quick collect payment i called to verify and the lady said ok but never took the mtcn number, if i hadnt called back i am sure they would have played it like they didnt know, ive only been with cap 1 for 45 days and its been a nightmare. the lost money order?? it never resurafced but was never cashed. the same day they should have recieved my payment they adjusted my proof of insurence so i know they recieved it.i never changed them as lien holder yet because of this. oynx is the current lien holder.but they show i did show them proof of change of lien holder. when in fact i did not send them proof. so somethings fishy there.

I realize that a lot of you are having trouble with Capital One but I would like to bring this out about them. 3 years ago I had my car financed through them and I totaled it. The insurace paid off all but $6,700.00 of it. I thought that Capital One was really going to let me have it. After the insurance paid their part I got a call from Capital One asking how much I could pay a month on the rest of the debt. I told them I had to buy another car and that all I caould pay was $100.00 a month. They said that was fine. a few months later I got another call just to confirm the aggrement and that was it. About every 6-7 months the same agant(Brian Resuo) would call and ask me how things were and just if I could pay more, when I said I could not he said that was fine. Then he called again for his 6-7 month call and told me that they would settle for $2,800.00 to 3,200 depends on when I could pay and he is going to put it in writting. I will pay this off in a few months and My agent said he would have the total settle amount sent to me by then. I have got noting but help from Capital One. They have been nice and not pushey. They did call my wifes job one time and I explained that that was not a good idea, but he could get me on my cell, he said he would not call my wifes work again, and he has not, he has kept his word. I know they want their money can you blame them, but I have tried my hardest to work with them and they have really tried hard to help me, and they have been nice to me every time. One time I got a litle rude and my agent was very nice and calm and it calmed me right down. I don't know why some have a hard time with them but I have had a very plesent experiance with them and they have been very paitient with me and the money I owe. If every company I had to deal with was as helpful as this one my life would be easier.
